The following rates and charges shall apply, and rules and regulations shall be adhered to by those consumers of water from the City water system: (Ord. 942, eff. 12-1-1977)
A. Monthly Rates:
1. Rates And Charges:
a. 2016:
(1) Monthly Rates And Charges: From and after September 7, 2016, this subsection A1a establishes the rates and charges to be made and collected by the City of Carmi for water sold and furnished to purchasers and consumers from the Municipal waterworks and distribution system of said City which shall be sold and paid for monthly at the following rates:
(A) For the first 1,000 gallons used per month: minimum rate - $11.68 per 1,000 gallons; ten gallons - $0.1168; hundred gallons - $1.1676; thousand gallons - $11.6760.
(B) For the next 4,000 gallons used per month: $23.49 per 4,000 gallons; ten gallons - $0.0587; hundred gallons - $0.5872; thousand gallons - $5.8722.
(C) For the next 5,000 gallons used per month: ten gallons - $0.0536; hundred gallons - $0.5358; thousand gallons - $5.3578.
(D) For all gallons over 10,000 gallons used per month: ten gallons - $0.0536; hundred gallons - $0.5358; thousand gallons - $5.3578.
The minimum charge per month shall be $11.68, and shall be subject to a City tax and rural rate adjustment, as follows.
(2) Rural Rates:
(A) For the first 1,000 gallons used per month: minimum rate - $14.65 per 1,000 gallons; ten gallons - $0.1465; hundred gallons - $1.4648; thousand gallons - $14.6475.
(B) For the next 4,000 gallons used per month: $29.11 per 4,000 gallons; ten gallons - $0.0728; hundred gallons - $0.7277; thousand gallons - $7.2765.
(C) For the next 5,000 gallons used per month: ten gallons - $0.0674; hundred gallons - $0.6738; thousand gallons - $6.7377.
(D) For all gallons over 10,000 gallons used per month: ten gallons - $0.0674; hundred gallons - $0.6738; thousand gallons - $6.7377.
The minimum charge for rural rates per month shall be $14.65, and shall be subject to a City tax.
b. 2017:
(1) Monthly Rates And Charges: From and after September 7, 2017, this subsection A1b establishes the rates and charges to be made and collected by the City of Carmi for water sold and furnished to purchasers and consumers from the Municipal waterworks and distribution system of said City which shall be sold and paid for monthly at the following rates:
(A) For the first 1,000 gallons used per month: minimum rate - $12.49 per 1,000 gallons; ten gallons - $0.1249; hundred gallons - $1.2493; thousand gallons - $12.4933.
(B) For the next 4,000 gallons used per month: $25.13 per 4,000 gallons; ten gallons - $0.0628; hundred gallons - $0.6283; thousand gallons - $6.2833.
(C) For the next 5,000 gallons used per month: ten gallons - $0.0573; hundred gallons - $0.5733; thousand gallons - $5.7329.
(D) For all gallons over 10,000 gallons used per month: ten gallons - $0.0573; hundred gallons - $0.5733; thousand gallons - $5.7329.
The minimum charge per month shall be $12.49, and shall be subject to a City tax and rural rate adjustment, as follows.
(2) Rural Rates:
(A) For the first 1,000 gallons used per month: minimum rate - $15.67 per 1,000 gallons; ten gallons - $0.1567; hundred gallons - $1.5673; thousand gallons - $15.6728.
(B) For the next 4,000 gallons used per month: $31.14 per 4,000 gallons; ten gallons - $0.0779; hundred gallons - $0.7786; thousand gallons - $7.7859.
(C) For the next 5,000 gallons used per month: ten gallons - $0.0721; hundred gallons - $0.7209; thousand gallons - $7.2094.
(D) For all gallons over 10,000 gallons used per month: ten gallons - $0.0721; hundred gallons - $0.7209; thousand gallons - $7.2094.
The minimum charge per month for rural rates shall be $15.67, and shall be subject to a City tax.
c. 2018:
(1) Monthly Rates And Charges: From and after September 7, 2018, this subsection A1c establishes the rates and charges to be made and collected by the City of Carmi for water sold and furnished to purchasers and consumers from the Municipal waterworks and distribution system of said City which shall be sold and paid for monthly at the following rates:
(A) For the first 1,000 gallons used per month: minimum rate - $13.37 per 1,000 gallons; ten gallons - $0.1337; hundred gallons - $1.3368; thousand gallons - $13.3679.
(B) For the next 4,000 gallons used per month: $26.89 per 4,000 gallons; ten gallons - $0.0672; hundred gallons - $0.6723; thousand gallons - $6.7231.
(C) For the next 5,000 gallons used per month: ten gallons - $0.0613; hundred gallons - $0.6134; thousand gallons - $6.1342.
(D) For all gallons over 10,000 gallons used per month: ten gallons - $0.0613; hundred gallons - $0.6134; thousand gallons - $6.1342.
The minimum charge per month shall be $13.37, and shall be subject to a City tax and rural rate adjustment, as follows.
(2) Rural Rates:
(A) For the first 1,000 gallons used per month: minimum rate - $16.77 per 1,000 gallons; ten gallons - $0.1677; hundred gallons - $1.6770; thousand gallons - $16.7699.
(B) For the next 4,000 gallons used per month: $33.32 per 4,000 gallons; ten gallons - $0.0833; hundred gallons - $0.8331; thousand gallons - $8.3309.
(C) For the next 5,000 gallons used per month: ten gallons - $0.0771; hundred gallons - $0.7714; thousand gallons - $7.7140.
(D) For all gallons over 10,000 gallons used per month: ten gallons - $0.0771; hundred gallons - $0.7714; thousand gallons - $7.7140.
The minimum charge per month for rural rates shall be $16.77, and shall be subject to a City tax.
d. 2019:
(1) Monthly Rates And Charges: From and after September 7, 2019, this subsection A1d establishes the rates and charges to be made and collected by the City of Carmi for water sold and furnished to purchasers and consumers from the Municipal waterworks and distribution system of said City which shall be sold and paid for monthly at the following rates:
(A) For the first 1,000 gallons used per month: minimum rate - $14.30 per 1,000 gallons; ten gallons - $0.1430; hundred gallons - $1.4304; thousand gallons - $14.3036.
(B) For the next 4,000 gallons used per month: $28.77 per 4,000 gallons; ten gallons - $0.0719; hundred gallons - $0.7194; thousand gallons - $7.1937.
(C) For the next 5,000 gallons used per month: ten gallons - $0.0656; hundred gallons - $0.6564; thousand gallons - $6.5636.
(D) For all gallons over 10,000 gallons used per month: ten gallons - $0.0656; hundred gallons - $0.6564; thousand gallons - $6.5636.
The minimum charge shall per month be $14.30, and shall be subject to a City tax and rural rate adjustment, as follows.
(2) Rural Rates:
(A) For the first 1,000 gallons used per month: minimum rate - $17.94 per 1,000 gallons; ten gallons - $0.1794; hundred gallons - $1.7944; thousand gallons - $17.9438.
(B) For the next 4,000 gallons used per month: $35.66 per 4,000 gallons; ten gallons - $0.0891; hundred gallons - $0.8914; thousand gallons - $8.9140.
(C) For the next 5,000 gallons used per month: ten gallons - $0.0825; hundred gallons - $0.8254; thousand gallons - $8.2540.
(D) For all gallons over 10,000 gallons used per month: ten gallons - $0.0825; hundred gallons - $0.8254; thousand gallons - $8.2540.
The minimum charge per month for rural rates shall be $17.94, and shall be subject to a City tax.
e. 2020:
(1) Monthly Rates And Charges: From and after September 7, 2020, this subsection A1e establishes the rates and charges to be made and collected by the City of Carmi for water sold and furnished to purchasers and consumers from the Municipal waterworks and distribution system of said City which shall be sold and paid for monthly at the following rates:
(A) For the first 1,000 gallons used per month: minimum rate - $15.30 per 1,000 gallons; ten gallons - $0.1530; hundred gallons - $1.5305; thousand gallons - $15.3049.
(B) For the next 4,000 gallons used per month: $30.79 per 4,000 gallons; ten gallons - $0.0770; hundred gallons - $0.7697; thousand gallons - $7.6973.
(C) For the next 5,000 gallons used per month: ten gallons - $0.0702; hundred gallons - $0.7023; thousand gallons - $7.0230.
(D) For all gallons over 10,000 gallons used per month: ten gallons - $0.0702; hundred gallons - $0.7023; thousand gallons - $7.0230.
The minimum charge per month shall be $15.30, and shall be subject to a City tax and rural rate adjustment, as follows.
(2) Rural Rates:
(A) For the first 1,000 gallons used per month: minimum rate - $19.20 per 1,000 gallons; ten gallons - $0.1920; hundred gallons - $1.9200; thousand gallons - $19.1999.
(B) For the next 4,000 gallons used per month: $38.15 per 4,000 gallons; ten gallons - $0.0954; hundred gallons - $0.9538; thousand gallons - $9.5380.
(C) For the next 5,000 gallons used per month: ten gallons - $0.0883; hundred gallons - $0.8832; thousand gallons - $8.8318.
(D) For all gallons over 10,000 gallons used per month: ten gallons - $0.0883; hundred gallons - $0.8832; thousand gallons - $8.8318.
The minimum charge per month for rural rates shall be $19.20, and shall be subject to a City tax. (Ord. 1508, 9-6-2016)
2. City Tax: A Carmi City Utility Tax of five percent (5%) shall be added to the water rate charges 2 . (Ord. 1425, 7-6-2010)
3. Monthly Meter Fee: In addition to the regular monthly charges for water purchase and consumption from the Municipal waterworks and distribution system of the City of Carmi, a flat rate monthly meter fee of four dollars ($4.00) shall be added to the monthly utility charges of all City and rural water customers whom are billed directly from the City of Carmi Light and Water Office.
This flat rate monthly water meter charge of four dollars ($4.00) shall become effective upon the approval date of said loan agreement and remain in force for the duration of this debt obligation not to exceed twenty (20) years. (Ord. 1509, 9-6-2016)
B. Tap Fees:
1. Within City Limits: Any person desiring a new connection to the water system shall pay to the City, in advance, as a hookup fee to defray the cost of meter and installation, the following charges:
3/4 inch service | $ 750.00 |
Additional setter inside City limits only | 400.00 |
1 inch service | 1,200.00 |
2 inch service | 6,500.00 |
2. Outside City Limits: The above charges shall be four hundred dollars ($400.00) additional for connections made outside the City limits.
3. Service Line Bore: In addition to the above charges (whether inside or outside the City), should a new connection require a service line bore, the person requesting the new connection shall pay in advance a one thousand five hundred dollar ($1,500.00) bore fee. An additional bore fee of $15.00 per foot shall be charged, after installation of service, for any bore beyond 100 feet at the completion of the installation.
C. Water Fire Prevention Sprinkler System Charge:
1. Annual Charge: For every business or person installing a water fire prevention sprinkler system in a building owned by such business or person, the City shall charge such business or person and shall be entitled to receive the sum of one hundred sixty four dollars ($164.00) per year for each fire hydrant, plus a charge of sixteen cents ($0.16) per water head, per sprinkler, per year, for each fire hydrant and water head installed on premises owned by such business or person.
2. Cost Of Materials: In addition to the annual charge above provided, any business or person installing a water fire prevention sprinkler system shall pay to the City the cost of all materials required to be installed by the City to provide adequate water supply to the premises owned by such business or person. D. Application For Service: Businesses or individuals desiring services from the waterworks shall make application to the City office. Said application shall be processed and connection made at the option of the City.
E. Service Lines And Meters:
1. City Authority: The City water system shall be responsible for installing and maintaining the service lines and meters of said water system and shall have the right to refuse service when the capacity of the City system will not permit more usage. (Ord. 942, eff. 12-1-1977)
2. Meter Required: No person shall use or attempt to use any water furnished by the City through its water mains without first having installed a water meter as provided herein. (Ord. 413, 12-5-1927)
F. Nonliability Of City: The City shall not be liable for damages or injuries to persons and/or property resulting from the installation and maintenance of said systems, and the City reserves the right to regulate the use of water as to the use or intended purpose on the consumer's premises.
G. Consumer Responsibility:
1. Service Lines And Meters: The consumer shall be responsible for installing and maintaining service lines from the meters to the point of usage, and to provide a suitable place for meters when located on the consumer's property.
2. Easement: The consumer further shall agree to give easement when any part of the City lines or equipment are located on his land.
3. Damage To System: A consumer shall further be responsible for damage to the water system's property and shall only use water for the specific uses set forth from time to time by the City.
H. City Review Of Plans And Specifications; Authority To Limit: The City maintains the right to limit the number and sizes of mains to conform with the use and capacity of the water system, and also reserves the right to make or allow extensions to the system as it deems advisable. All plans and specifications shall be reviewed and approved by all appropriate City, State and Federal agencies, and any permit for connections or additions are subject to such review and approval.
I. Change Of Occupancy, Duty Of New Occupant: In the case of change of occupancy of a residence, it shall be the duty of the new occupant to notify the City of said change, and it shall be the responsibility of the new occupant to see that any water originally consumed is paid for or such new occupant shall be liable for said previous use. There shall be a charge of two dollars ($2.00) paid to the City for each new resident because of a residence change.
J. Reading Meters; Billing 3 : The meters shall be read monthly and bills prepared and mailed on or about the first day of each month for water used to the date of reading.
K. Leak In Water Line; Repair By Customer:
1. Demand Of City To Repair: If a City water customer has a leak in his water line or water system, same shall be repaired immediately upon demand of the City.
2. Failure To Repair; Discontinuance Of Service: Failure of any City water customer to repair leaks to his water line or water system after demand made in writing by the City shall result in a discontinuance of water service to that customer.
L. Water Main Access: any new water service added onto the City of Carmi water service must have a minimum of forty (40) feet of water main access. (Ord. 942, eff. 12-1-1977; amd. Ord. 1165, 3-18-1991; Ord. 1171, 7-15-1991; Ord. 1426, 8-17-2010; Ord. 1573, 6-1-2021; Ord. 1575, 6-1-2021)
