7-5-2: MAINTENANCE OF CULVERTS:
It shall be the duty of the railroad corporation whose railroad tracks pass through the city to construct, maintain and keep in repair ditches, culverts or sewers sufficient to properly drain all pools, ponds or other places where the track of said railroad corporation may obstruct the natural or artificial drainage of the streets, alleys or other lands or lots within the limits of the city, and when they fail to do so, after thirty (30) days' notice in writing, as provided in subsection 7-5-1B of this chapter in case of their neglect to construct and repair crossings, it shall be the duty of the appropriate city official to construct such sewers, ditches or culverts, and such railroad corporation shall be responsible for all necessary expense incurred in making such construction and be liable to a fine as provided in section 1-4-1 of this code for failure to comply with the provisions of this section.
