7-5-1: MAINTENANCE OF CROSSINGS:
   A.   Railroad Responsibility: At all the railroad crossings with highways or streets within the limits of the city, the railroad corporation whose tracks cross any such highways or streets shall construct and maintain such crossings and the approaches thereto within and upon their respective rights of way, so that at all times they shall be safe, as to personal property.
   B.   Notify Railroad Company To Repair: Whenever any railroad corporation shall neglect to construct and maintain any of the crossings and approaches as provided in subsection A of this section, it shall be the duty of the appropriate city official to notify in writing the nearest agent of such railroad corporation of the condition of said crossing and approaches, and direct the same to be constructed, altered or repaired in such manner as he may deem necessary for the safety and convenience of persons and property.
   C.   Maintenance By City: If such railroad corporation shall neglect or refuse, after being notified by the appropriate city official, to construct and maintain any of the crossings or approaches as provided in subsection A of this section within thirty (30) days after such notice, then it shall be the duty of the appropriate city official to forthwith cause such construction, alteration or repair to be made.
   D.   Liability For Maintenance: Such railroad corporation shall be responsible for all necessary expenses incurred in making such construction, alteration and repairs and in addition thereto shall be fined as provided in section 1-4-1 of this code for neglect to comply with the requirements of this chapter.
