5-1-4: RULES OF CONDUCT:
The following shall apply to all persons paid fully or in part by the Carmi police department or assigned as an employee of the city:
   A.   Violations Of Laws: Personnel of the city police department shall not violate or attempt to violate any federal, state, county, township, or municipal law.
   B.   Obedience To Court Decisions: Personnel of the city police department will obey all decisions and orders of courts having jurisdiction.
   C.   Obedience To Superiors: Personnel will obey and fully execute any lawful order, written or oral, given by or relayed by a superior officer, which shall include, but not be necessarily limited to, these rules and regulations, or general and special orders, policies and procedures of the department.
   D.   Conflicting Orders: Officers who are given an otherwise proper order which is in conflict with a previous order, rule, regulation or directive, shall respectfully inform the superior issuing the order of the conflict. If the superior issuing the order does not alter or retract the conflicting order, the order shall stand. Under these circumstances, the responsibility for the conflict shall be upon the superior. Officers shall obey the conflicting order and shall not be held responsible for disobedience of the order, rule, regulation or directive previously issued. Officers shall not obey any order which they know or should know would require them to commit any illegal act. If in doubt as to the legality of an order, officers shall request the issuing superior to clarify the order or to confer with higher authority.
   E.   Use Of Alcohol And Narcotic Drugs: The use and possession of alcoholic beverages or narcotic drugs will be governed by the following rules:
      1.   Personnel will never use or be under the influence of alcoholic beverages while in a recognizable city police department uniform.
      2.   The use of narcotic drugs is prohibited, except when used as a medication, as directed by a licensed physician. When narcotic drugs are taken or administered prior to or during duty periods, a written statement from the attending physician will be required stating that its effects should in no way hinder the individual's performance.
      3.   The consumption of non-narcotic medication is prohibited when it is reasonable and prudent to believe such medication will hinder the individual's performance on duty.
      4.   The presence of an alcoholic beverage or narcotic drug in any city police facility or vehicle is prohibited; except, that which is held for evidence or training purposes.
      5.   Except in the performance of duty, personnel in a recognizable city police department uniform will not enter any establishment or place where the principal business is the sale of alcohol.
   F.   Altering Documents: Personnel shall not steal, alter, forge, or tamper with any police record, report or citation.
   G.   Removal Of, Duplicating Documents: To this end, the removal of any record, card, report, letter, document, or other official file from the department, except by process of law is prohibited. Additionally, the obtaining/duplication or attempted obtaining/duplicating of any information of department files, sources, or reports, other than that to which one is properly entitled in accordance with duties/assignments is prohibited.
   H.   False Statements Or Reports: Personnel shall not knowingly make a false statement or false report.
   I.   Enforcement Duties: It shall be the duty of the members of the police department to enforce all ordinances of the city and all statutes applicable therein, and to preserve order and prevent infractions of the law and may arrest violators thereof.
   J.   Aid To Other Officers: All police officers shall render prompt and efficient aid to each other in the discharge of their duties.
   K.   Unnecessary Force:
      1.   Personnel will not use more force than is reasonably necessary to accomplish lawful purpose and will be governed by statute and case law affecting the use of force.
      2.   In the event a person is struck by an officer while being arrested or being held in custody, or for any other reason, which results in the need of medical attention, the officer shall see that the person struck is taken to a hospital for examination by a physician.
   L.   Courtesy: Personnel should be courteous to all persons at all times; the public should not be unnecessarily humiliated or embarrassed.
   M.   Identification Of Self: Personnel requested to identify themselves will state their rank, name and badge number.
   N.   Maintain Proper Arrest Relationships: Personnel will obey the following rules in their relationships with persons under arrest or in custody:
      1.   Personnel shall not post bond for any person.
      2.   Personnel shall not recommend the retention of specific attorneys, law firms, bondsmen, or bonding companies.
   O.   Membership In Organizations Restricted: Personnel are prohibited from joining or affiliating with any group whose charter, constitution, or bylaws conflict with the duties or responsibilities of the city police department.
   P.   Legal Papers Served: Personnel served with legal papers which could have a substantive effect on the department or which arise as the result of the performance of duty will report the circumstances in writing to the chief of police. The chief of police shall forward all necessary reports to the city attorney and/or state's attorney.
   Q.   Home Visits From Defendants: No complainant, defendant, or member of their family is to be transported, encouraged to call by phone, or visit in person at any officer's home, unless by prior consent.
   R.   Labor Disputes: Personnel shall not enter into any building, structure, or premises where persons have been placed to indicate a labor dispute in progress, except when necessary in the performance of duty. To this end, strict impartiality shall be followed and gratuities, food and/or drink shall not be accepted from a party participating in the dispute.
   S.   Use Of Position For Personal Gain: Personnel of the department shall not use the prestige or influence of one's official position, or use of the time, facilities, equipment or supplies of the department for the private gain or advantage to oneself or another.
   T.   Gambling: Officers shall not engage or participate in any form of illegal gambling at any time, except in the performance of duty and while acting under proper and specific orders from a superior.
   U.   Labor Unions:
      1.   Officers shall have the right to join labor organizations, but the decision to recognize or to engage in collective bargaining with any labor organization except as provided by law will rest with the city and county.
      2.   Officers shall not engage in any strike. "Strike" includes the concerted failure to report for regular or special duty, wilful absence from one's position, unauthorized holidays, sickness unsubstantiated by a physician's statement, the stoppage of work, or the abstinence in whole or in part from the full, faithful and proper performance of the duties of employment for the purposes of inducing, influencing or coercing a change in conditions, compensation, rights, privileges or obligation of employment.
