4-2-3: VENTED GAS APPLIANCES:
   A.   Definitions:
GAS APPLIANCE: 1. Any device using gas, whether artificial, liquefied petroleum, or natural, to produce heat, light or power, except as hereinafter provided.
      2.   There is excepted from the term "gas appliance", as used and defined herein, the following:
  a. Cooking stoves.
  b. Refrigerators.
  c. Any other gas appliance with a rating of ten thousand (10,000) BTU input per hour or less, provided such appliance is not located in any room or enclosure used for sleeping purposes.
   VENTED: A pipe, tube or enclosed passage, or a combination thereof, connected to the appliance and leading from the appliance into the open air outside any structure. Such vent must be of sufficient size, of a generally accepted design, and installed in such a way as to carry off all harmful products and byproducts of combustion from the appliance and into the open air. Any installation which fails to meet the foregoing requirements is improperly vented.
   B.   Prohibitions:
      1.   Unvented Gas Appliances: In the city, it shall be unlawful for any person to install, maintain, or have on any premises any gas appliance which is not vented, or is improperly vented.
      2.   Supplying Gas To Unvented Appliances: It shall be unlawful for any party, person, or public utility to knowingly furnish or supply artificial, liquefied petroleum, or natural gas to any premises on which there is any appliance in use which is not vented in compliance with the provisions of this section, and any such party, person, or public utility shall have, under this section, the right to refuse to furnish or supply such gas to any premises where any gas appliance in use is not vented in accordance with the provisions hereof, provided such right does not contravene any statute of the state or the rules and regulations of the Illinois commerce commission.    C.   Penalty: Any person or public utility found guilty of a violation of this section shall be subject to fine as provided in section 1-4-1 of this code for each offense. (Ord. 748, 2-2-1959; amd. 2006 Code)
