1034.04 DEFINITIONS.
   The following list of definitions and abbreviations is provided to aid in the general understanding of these Rules and Regulations; unless the context specifically indicates otherwise. The definitions and meaning of abbreviations shall be as indicated hereinafter. A.W.W.A. shall mean the American Water Works Association.
   (1)   "Act" means the Safe Drinking Water Act of 1974 and Federal Water Pollution Control Act, Public Law 92 500 and any amendments thereto as well as any guidelines, limitations and standards promulgated by the Environmental Protection Agency pursuant to the Act.
   (2)   "Air gap separation" means the unobstructed vertical distance through the free atmosphere between the lowest opening from any pipe or faucet supply water to a tank, plumbing fixture or other device and the flood level rim of the receptacle. The distance shall be twice the pipe diameter but never less than one inch.
   (3)   "Approved" means that a backflow prevention device or method has been accepted by the Municipal Water Department and the Ohio Environmental Protection Agency as suitable for the proposed use.
   (4)   "Auxiliary water system" means any water system on or available to the premises other than the public water system and includes the water supplied by the system. These auxiliary waters may include water from another purveyor's public water system; or water from a source such as wells, cisterns, lakes or streams; or process fluids; or used water. They may be polluted or contaminated or objectionable or constitute a water source or system over which the waterworks does not have control.
   (5)   "Backflow" means the flow of water or other liquids, mixtures or substances into the distributing pipes of a potable water supply from any source other than the intended source of the potable water supply.
   (6)   "Backflow prevention device" means any device, method or type of construction intended to prevent backflow into a potable water system.
   (7)   "Consumer" means the owner or person in control of any premises supplied by or in any manner connected to a public water system.
   (8)   "Consumer's water system" means any water system, located on the consumer's premises, supplied by or in any manner connected to a public water system. A household plumbing system is considered to be a consumer's water system.
   (9)   "Contamination" means an impairment of the quality of the water by sewage or process fluids or waste to a degree which could create an actual hazard to the public health through poisoning or through spread of disease by exposure.
   (10)   "Contractors" shall include building, plumbing, paving, sidewalk, sewer, water, etc., contractor, or others who perform work of this or similar type as individuals or partnerships, and doing work for private or governmental agencies.
   (11)   "Corporation cock" means a valve inserted or tapped into a water main, under pressure, for the purpose of regulating the flow of water into a service line.
   (12)   "Council" means the Council of the Municipality of Carlisle.
   (13)   "County" means Warren County, Ohio unless indicated otherwise.
   (14)   "Cross connection" means any arrangement whereby backflow can occur.
   (15)   "Curb box" means a riser that fits over the curb stop, reaching to ground level, with a lid, that enables a key to be used to turn the curb stop off and on.
   (16)   "Curb cock" means a valve placed at the edge of right-of-way whereby water service can be shut off to a service line.
   (17)   "Customer" shall also be used to mean "consumer."
   (18)   "Detector check" means a valve designed to prevent the reverse flow of fire protection system substances, i.e. glycerin wetting agents, stagnant water and water of nonpotable quality from being pumped or siphoned into the potable water line. This valve also incorporates a meter which allows the Municipality to detect leaks in the fire system and also provides a detection point for determining unauthorized use. This valve shall meet or exceed the following standards for double check assemblies: A.W.W.A. Standard C 506.
   (19)   "Degree of hazard" is a term derived from an evaluation of the potential risk to health and the adverse effect upon the potable water system.
   (20)   "Department" means the Service Department of the Municipality of Carlisle, Ohio.
   (21)   "Director" means the Director of the Service Department of the Municipality of Carlisle, Ohio, and also is known as the Superintendent of Water/Wastewater Department.
   (22)   "Distribution system" means the water system of the Municipality.
   (23)   "Double check valve assembly" means an assembly composed of two single, independently acting, check valves including tightly closing shut off valves located at each end of the assembly and suitable connections for testing the water tightness of each check valve.
   (24)   "Engineer" means the appointed representative of the Municipality of Carlisle who is a registered professional engineer.
   (25)   "Easement" means a grant by the owner of land for a specified use of land for the installation and maintenance of water lines and appurtenances for an indefinite period of time.
   (26)   "Fire protection service connection" means any connection to the water distribution system used for the purpose of fire fighting or fire protection.
   (27)   "Health hazard" means any condition, device or practice in a water system or its operation that creates, or may create, a danger to the health and well being of users. The word "severe" as used to qualify "health hazard" means a hazard to the health of the user that could reasonably be expected to result in significant morbidity or death.
   (28)   "Inside split" means any physical connection made to a single service line inside a structure, for the purpose of serving more than one customer.
   (29)   "Interchangeable connection" means an arrangement or device that shall allow alternate but not simultaneous use of two sources of water.
   (30)   "Inspector" means a representative of the Municipality of Carlisle who is responsible for the enforcement of the specifications and quality of construction.
   (31)   "Interpretation" means provisions of this chapter shall be the minimum requirements adopted for the promotion of health, safety, and welfare of the constituents of the Municipality. These provisions are not intended to repeal, abrogate, annul or in any manner interfere with any laws or rules of any governmental units having jurisdictions that are more stringent. Where these provisions impose greater restrictions than those of existing laws or rules, then the provisions of this chapter may be promulgated by the Municipality to cover unusual situations.
   (32)   "Manager" means the Manager of Carlisle, Ohio.
(33)   "Maintenance" means the keeping of the distribution system in a state of repair and shall include expenditures necessary during the service life of the treatment works to maintain the capability for which the treatment works and distribution system were designed and constructed.
   (34)   "May" means permissive.
   (35)   "Meter" means a device for measuring the use and flow of water.
   (36)   "Meter spread or jumper" means a length of pipe used to set the distance on a service line where a meter is to be installed.
   (37)   "Personnel" means inspectors, meter readers, employees, or representatives of the Municipality whose duty constitutes entrance upon private property shall be equipped with proper credentials as the Municipality may deem necessary to have access to the premises for the proper operation and maintenance of the Municipal facilities. Should access of the premises be denied, the Municipality shall discontinue service and will not restore the same until such time as access is granted. The Municipality shall not accept keys for the purpose of gaining access to read a customer's meter.
   (38)   "Meter yoke" means a device used for mounting a meter on the service line, in a meter pit, which provides the proper spacing for the meter setting.
   (39)   "Minimum water service charge" means the minimum charge to be made to a system user for water service and credited to the total water service charge at the applicable rate as established by ordinance.
   (40)   "Municipality" means the Municipality of Carlisle, Ohio.
   (41)   "Natural outlet" means any outlet into a watercourse, pond, ditch, lake, or other body of surface or ground water.
   (42)   "Non potable water" means water not safe for drinking, personal or culinary use.
   (43)   "Nuisance" means anything which is injurious to health or is indecent or offensive to the senses or is an obstruction to the free use of property so as to interfere with human comfort or enjoyment of life or property.
   (44)   "Operation, maintenance and replacement (OM&R)" means the cost of providing water service by the distribution system in accordance with design criteria, and sound economic practices. In particular "operation" means the means and methods used to facilitate the proper and intended usage of the treatment facility; "maintenance" means the general upkeep of the water system and "replacement" means the expenditures for procuring and installing equipment necessary for the efficient and proper utilization of the water system throughout the service life of such system.
   (45)   "Owner" shall be defined as the person who holds actual, not merely equitable, title to the property. Executors, administrators of estates, and persons who hold property in trust shall be considered owners.
   (46)   "Penalties" means unless otherwise specified herein, whoever violates these provisions of this chapter is guilty of interference with a public utility, a minor misdemeanor and shall be subject to such fine as provided at Ohio R.C. 2929.21. Whoever violates these provisions shall additionally be liable and responsible for any and all monetary damages incurred as a result of the violation. Any violation of any section of this chapter for which no penalty is specifically provided shall be punishable by a fine of one hundred dollars ($100.00). Each day or act of violation of these provisions is considered a separate offense.
   (47)   "Permit" means a document issued by the Municipality of Carlisle, giving permission to connect to the water supply system and/or to extend or repair the same.
   (48)   "Person" means any individual, partnership, copartnership, firm, company, corporation, association, joint stock company, trust, estate, governmental entity or any other legal entity or their legal representatives, agents or assigns.
   (49)   "Pollution" means the presence in water of any foreign substance that tends to degrade its quality so as to constitute a hazard or impair the usefulness or quality of the water to a degree which does not create an actual hazard to the public health but which does adversely and unreasonably affect such waters for domestic use.
   (50)   "Pollutional hazard" means a condition through which an aesthetically objectionable or degrading material not dangerous to health may enter the public water system or a consumer's potable water system.
   (51)   "Potable water" means water which is satisfactory for drinking, culinary and domestic purposes and meets the requirements of the Ohio Department of Health.
   (52)   "Premises" means a parcel of real estate including any improvements thereon which is determined by the Department to be a single user of the water system.
   (53)   "Pressure regulator" means a device connected to the service line before the meter for the purpose of regulating the pressure so that it does not exceed what the meter will withstand.
   (54)   " Private service" means any water system and appurtenances that are privately owned and maintained but have water conveyed to the system by an adjoining Municipal system.
   (55)   "Private water" means a water that is controlled by the Municipality but owned, operated and maintained by others.
   (56)   "Process fluids" means any fluid or solution which may be chemically, biologically or otherwise contaminated or polluted in a form or concentration such as would constitute a health, pollution or system hazard if introduced into the public or a potable consumer's water system. This includes, but is not limited to:
      A.   Polluted or contaminated waters;
      B.   Process waters;
      C.   Used waters originating from the public water system which may have deteriorated in sanitary quality;
      D.   Cooling waters;
      E.   Contaminated natural waters taken from wells, lakes, cisterns, streams or irrigation systems;
      F.   Chemicals in solution or suspension; and
      G.   Oils, gases, acids, alkalis and other liquid and gaseous fluids used in industrial or other processes, or for fire fighting purposes.
   (57)   "Public water" means any publicly or privately owned potable water system subject to Ohio R.C. 6111.13.
   (58)   "Reduced pressure principle backflow prevention device" means a device containing a minimum of two independently acting check valves together with an automatically operated pressure differential relief valve located between the two check valves. During normal flow and at the cessation of normal flow, the pressure between these two checks shall be less than the supply pressure. In case of leakage of either check valve, the differential relief valve, by discharging to the atmosphere, shall operate to maintain the pressure between the check valves at less than the supply pressure. The unit shall include tightly closing shut off valves located at each end of the device, and each device shall be fitted with properly located test cocks.
   (59)   "Service connection" means that line extending from the Municipal water main to the water meter inlet.
   (60)   "Service fee" and "tap in fee" mean the fee charged for having a water system available for use by persons wishing to build in the Municipality. Such fee is determined by the cost of wells, pumping, facilities, storage, water mains, etc.
   (61)   "Service line" means the pipe or conduit by which water is conveyed or drawn from the main to the premises to be served.
   (62)   "Shall" is mandatory; "may" is permissive.
   (63)   "System hazard" means a condition posing an actual or potential threat of damage to the physical properties of the public water system or a potable consumer's water system.
   (64)   "Standard methods" means the laboratory procedures set forth in the latest edition of Standard Methods for the Examination of Water and Wastewater, as prepared and published jointly by the American Water Works Association, American Public Health Association and the Water Pollution Control Federation.
   (65)   "State" means the State of Ohio unless indicated otherwise.
   (66)   "System user" means any user of the water system.
   (67)   "Tee" means a device attached to the water main which allows for the placement of a water hydrant.
   (68)   "Test procedures (analytical testing)" means all methods of sample collection, preservation and analysis as prescribed in the Federal Regulation 40 CFR 136, Test Procedures for the Analysis of Pollutants. Unless indicated otherwise, the test procedures employed by the Municipality shall conform to those described in Standard Methods for the Examination of Water and Wastewater. See subsection (a)(39) hereof.
   (69)   "User charge" (formerly known as tap in fee) means the system access charge for providing water service and shall be established by ordinance as proportionate to the Department's cost for capital improvement.
   (70)   "Used water" means any water supplied by a water purveyor from a public water system to a consumer's water system after it has passed through the service connection and is no longer under the control of the water purveyor.
   (71)   "Violation" means any infraction of the provisions of this chapter is a violation. Whoever tampers with or attempt to use facilities provided by the Municipality without first obtaining the necessary permits and approvals is in violation of the provisions. Whoever obtains a permit or approval based on false information made in order to deceive the Municipality will be deemed in violation of these provisions.
   (72)   "Water main" means a pipe which is part of the Municipal distribution system and the conductor of the water being delivered to consumers on the system.
   (73)   "Water purveyor" means the owner or operator of a public water system.
   (74)   "Water constituents and characteristics" means the individual chemical, physical, bacteriological and radiological parameters including volume and flow rate and such other parameters that serve to define, classify or measure the contents, quality and quantity of water.
   (75)   "Waterworks treatment plant" means any arrangement of devices and structures used for the treatment of water.
   (76)   "Watercourse" means any channel in which the flow of water occurs either continuously or intermittently.
   (77)   "Waters of the State" means all streams, lakes, ponds, marshes, watercourses, wells, springs, reservoirs, aquifers, irrigation systems, drainage systems and all other bodies or accumulations of water, surface or underground, natural or artificial, public or private which are contained in, flow through or border upon the State or any portion thereof.
   (78)   "Water tap" means the intersection at which a service line is connected to the water main.
   (79)   "Workdays" means days on which work is performed by the Municipality, normally weekdays, excepting holidays.
