(a) In addition to any other penalties set forth in Sections 1030.01 to 1030.20, and the remedy of specific performance which may be enforced in the Magistrate Court, the following penalties shall apply:
(1) Any person, firm, corporation, or permittee violating Section 1030.01(d) or 1030.12(a) shall be guilty of a misdemeanor of the fourth degree. Each day such violation continues shall be deemed a separate offense; and
(2) For failure to comply with any other provision of Sections 1030.01 to 1030.20, the penalty shall be a civil forfeiture, payable to the Municipality, in the amount of one hundred dollars ($100.00) per day for each day of violation.
(b) Any permittee may be excused for violations of Sections 1030.01 to 1030.20 and its permit for reasons of force majeure.
