624.16 PRESCRIPTION DRUGS.
   (a)   No person, other than a wholesale distributor of dangerous drugs, a licensed terminal distributor of dangerous drugs, a manufacturer of dangerous drugs, a pharmacist, a practitioner or a carrier or warehouseman carrying or storing drugs in the course of his or her business for any of the foregoing, shall have in his or her possession any prescription drugs, except those obtained pursuant to a prescription or dispensed by a practitioner.
   (b)   Proof of possession of a prescription drug other than in a container labeled to indicate his or her own name, address and registry number or the name, address and registry number of the owner of the pharmacy for whom he or she is acting; the name and address of the person for whom the drug is prescribed, or, if an animal, the name and address of the owner thereof and the species of the animal; the name, address and registry number of the practitioner by whom the prescription was written; and such directions as may be stated for the use of the prescription, shall constitute prima-facie evidence of a violation of this section. Insulin is excepted from this division.
   (c)   Whoever violates this section is guilty of a misdemeanor of the first degree and shall be subject to the penalty provided in Section 698.02.
