618.19 RESTRICTING CERTAIN ANIMALS.
   (a)   Fowl. No person shall keep chickens or other poultry in any dwelling or within one hundred Feet of dwelling or property line.
   (b)   Rabbits. No person shall keep rabbits in any dwelling or within twenty-five feet of dwelling or property line.
   (c)   Hogs. No person shall keep hog/pig which has attained the age of five (5) months, within the limits of the Municipality, except that:
      (1)   Obtained a license. Application for the license shall be made to the Zoning Administrator. The license fee for pot-bellied pigs shall be as set forth in the General Fee Schedule which shall contain the following information:
         A.    The name and address of the applicant and the address of the property upon which the pot-bellied pig is to be kept.
         B.    The name, age and Weight and height of the pot-bellied pig including any identifying marks or tattoos.
         C.    Such other information as the Zoning Administrator deems appropriate.
         D.    Veterinary Certification. The application shall be accompanied by a statement signed by licensed veterinarian certifying that the pot-bellied pig has been spayed/neutered, that the pig is in good health and has received all necessary vaccination, and the height and weight of the pig. Such certification shall be no older than thirty calendar days when submitted to the Zoning Administrator.
      (2)   Issuance, term, renewals.
         A.    The Zoning Administrator shall issue a license for the keeping of a pot-bellied pig on a lot within the Municipality upon the filing of a completed application and a finding that the animal meets the requirements set forth in subsections A. through D. of Section 618.19(c)(1).
         B.    Term of license. Any license issued pursuant to this chapter shall be valid for a period of one year from the date of issuance; provided, however, any license expiring on a Saturday, Sunday or holiday shall be valid until the next work day.
         C.    Renewals. Any license issued pursuant to this Chapter may be renewed for periods of one year each upon the filing of an application for such renewal with the Zoning Administrator accompanied by nonrefundable renewal fee in an amount as set for the General Fee schedule. The renewal application shall be on such form as provided the Municipality. The Zoning Administrator shall issue such renewal license unless it is found that the pot-bellied pig is not in compliance with the regulations as set forth in this Section.
      (3)   Regulations.
         A.    No more than one potbellied pig may be kept in a single-family dwelling as defined in this code;
         B.    A potbellied pig is defined as one which meets the requirements of and is registered with the Potbelly Pig Registry Service, Inc. of Lakeville, Indiana and/or the International Potbelly Pig Registry Service of Pescadero, California;
         C.    Each potbellied pig shall be a pet, that is to be kept for personal enjoyment and not kept or raised for human consumption;
         D.    The maximum weight of a potbellied pig shall not exceed sixty-five pounds. If the weight exceeds sixty-five pounds, the potbellied pig shall be removed;
         E.   Potbellied pigs shall not be bred within the Municipality;
         F.    Potbellied pigs must be spayed or neutered if three months or older;
         G.    Height. The pot-bellied pig shall not exceed eighteen inches in height as measured from the shoulder of said animal.
         H.    De-tusked. Any male pot-bellied pig two years of age or older must have his tusk removed.
         I.    If a potbellied pig is taken off its owner's property, it shall be on a secure leash that is not more than six feet in length which is held in the hand of a person who is of suitable age and discretion;
         J.    Waste from potbellied pigs must be removed in an appropriate manner to prevent health and odor problems;
         K.    Potbellied pigs shall reside in the residence of the owner as a house pet and shall not be kept in an outside pen; and
         L.    If a potbellied pig becomes a nuisance, disturbs the tranquility of the surrounding neighborhood, or becomes a health problem, the Zoning Administrator shall have the authority to order and have the potbellied pig removed from the Municipality;
         M.    Any person found guilty of violating the provisions of this section shall pay all expenses, including shelter, food, and veterinary expenses necessitated by the seizure of any potbellied.
   (d)   Other Hoofed Animals.
      (1)   No person shall keep, harbor or maintain any horse, pony, cow, calf, goat, hog or other hoofed animal other than those specifically exempted by this section in the Municipality, except that the keeping, harboring or maintaining of any such animals may be authorized by the Zoning Administrator by permit duly issued therefore, provided that such animals are located on lots or parcels of three acres or more.
This prohibition and conditions do not apply when not more than one spayed or neutered pygmy goat, defined as meeting the requirements of the National Pygmy Goat Association located in Mendon, Massachusetts, is kept as a pet in a single-family dwelling. However, any owner or keeper of a pygmy goat shall:
         A.    Keep the pygmy goat, when it is outdoors, in an area enclosed by a fence at least four feet in height;
         B.    Provide suitable shelter to protect the pygmy goat from the elements that must be 25 ft. from any property line and 25 feet of dwelling;
         C.    Promptly remove and dispose of all goat droppings.
         D.    Such permits may be issued by the Zoning Administrator on written application therefore in such form as the Zoning Administrator requires, and shall specify any restrictions, limitations, conditions, or prohibitions which the Zoning Administrator deems reasonably necessary to protect any person or any neighboring use from unsanitary conditions, unreasonable noise or odors, or other annoyance, or to protect the public health or safety. All such animals kept in connection therewith shall be located no closer than fifty feet to any building used or designed for human habitation.
         E.    The Zoning Administrator shall investigate or cause to be investigated the keeping of, any such hoofed animals. The Zoning Administrator may, at its discretion, conduct a public hearing on the manner and extent of keeping or maintaining such hoofed animals and, following such public hearing, may impose such limitations, restrictions, conditions, or prohibitions on the keeping or maintaining of any such hoofed animals on the premises as, in its sound judgment, are reasonably necessary to protect any person or any neighboring use from unsanitary conditions, unreasonable noise or odors, or other annoyance, or to protect the public health or safety.
