258.07 LOCAL PREFERENCE.
   (a)   In competitive bid awards for the purchase of commodities and non-professional services, the Municipality may grant a local preference to businesses located with the Municipality. In determining the lowest and best bidder or vendor, a five percent local preference may be computed on the amount of the low bid meeting specifications by a non-Municipal bidder/vendor. The preference may be applied up to a maximum of five percent or five thousand dollars ($5,000), whichever is less.
   (b)   When proof of situs is required, the bidder/vendor must authorize a release of information necessary to the Municipality to establish the business location.
   (c)   (1)   Ties between one Municipal bidder/vendor and one or more non-Municipal bidder/vendor(s) meeting specification shall be broken in favor of the Municipal bidder/vendor.
      (2)   Ties between two or more Municipal bidder/vendors meeting specifications shall be broken through a coin toss method until the winner remains.
   (d)   The Manager or her designate may promulgate rules and regulations to implement this section provided they are not inconsistent with the expressed provisions of this section.
