246.08 USER FEE FOR DEPLOYMENT OF EQUIPMENT AND STAFF AT MOTOR VEHICLE ACCIDENTS AND FIRE RUNS.
   (a)   Beginning January 1, 2002, the Fire Department shall initiate a new user fee for the delivery of Fire Department services, personnel, supplies and equipment to the scene of motor vehicle accidents and fire calls. The rate of the user fee shall be that which is the costs incurred, which includes any services, personnel, supplies and equipment, and may fluctuate based on the needs of the accident.
   (b)   The user fee shall be filed to the Motor Vehicle Insurance coverage, representing an add-on cost of the claim for damages of the vehicles, property and/or injuries. The claim costs shall be filed only to the insurance coverage of the cited or responsible insured party or parties as determined by the police or other litigating entities. It has been determined by the National Insurance Institute that such claims filed by the Fire Department will not cause an increase to the premiums of the insured, other than what would have normally occurred with the insured from bad credit, a high rate of accidents or a bad driving record.
   (c)   Fire calls billed to Home Owner's Insurance at a value based on time spent and fire damage. It has been determined by the National Insurance Institute that such claims filed by the Fire Department will not cause an increase to the premiums of the insured, other than what would have normally occurred with the insured from bad credit, a high rate of accidents or bad driving record.
   (d)   The Fire Department or their representatives shall not attempt to make any threats for any uncollected balances or cause damage to the credit rating from claims submitted to Motor Vehicle Insurance and Home Owner's Insurance companies of any residents of the Municipality resulting from the accidents and fires.
   (e)   The Manager and/or Finance Director are authorized and directed to contract with a company specializing in the billing of Fire Department services and motor vehicle accidents and fire calls for collection of user fees as results of Fire Department services being provided.
   (f)   All amounts collected as a result of this section shall be placed into a fund as established by the Finance Director to be used exclusively for personnel, supplies and equipment for the Fire Department.
