(a) No person under sixteen years of age shall be on, remain, tarry or stay unnecessarily upon any street, highway, alley or other public place in the Municipality after 10:00 p.m. and before 5:00 a.m. the next day unless:
(1) Such person is accompanied by a parent or guardian, or other person having custody of such minor.
(2) Such person is in lawful employment making it necessary to be in such places after 10:00 p.m.
(3) Being out on an errand for a parent or guardian.
(4) Involved in interstate travel.
(5) Traveling or returning from employment.
(6) Attending or traveling to and from religious, school or civic activity.
(7) Exercising any First Amendment Right.
(8) A legitimate excuse:
A. Emergency errand
B. Legitimate business activity directed by parent, guardian or adult.
(9) On a sidewalk in front of the minor's residence.
*The constitution requires the ordinance to be "narrowly tailored" to meet the Village's
compelling state interest. (Strict scrutiny test)
* Attendant risk of mischief of juveniles, promote safety and good order of the community and reducing juvenile criminal activity. (Ord. 2023-02. Passed 3-8-23.)
