1386.09 RIGHT OF ENTRY.
   (a)    Whenever necessary to make an inspection to enforce any of the provisions of this chapter, or whenever the Zoning Inspector has a reasonable basis to believe that there exists in any building or upon any premises any condition which makes the building or premises open, unsafe, dangerous, or hazardous, the Zoning Inspector may enter such building or premises to inspect the same or to perform any duty imposed upon the Zoning Inspector by law.
   (b)    When it is necessary for the Zoning Inspector to make such inspections, surveys, and examinations of premises, buildings or structures not open to the public, the Zoning Inspector
shall:
(1)    Make such entry as may be required between the hours of 8:00a.m. and 5:00 p.m., Monday through Friday of each week, excluding holidays, unless otherwise requested by the Owner, occupant, or person in charge.
(2)    Notify the Owner, occupant, or person ih charge in advance of the proposed inspection.
(3)    Propose to the Owner, occupant, or person in charge thereof proper credentials issued by the Village.
(4)    Obtain consent of the Owner, occupant, or person in charge, who is present, at any building or structure prior to entry.
   (c)    It shall be the duty of any authorized official required to make any inspections, surveys, and examinations to obtain a warrant, and to proceed in accordance with the requirements of the law, whenever the Owner, occupant, or person in charge, who is present, thereof refuses to consent to entry as provided above.
   (d)    When the Zoning Inspector shall have first obtained the proper inspection warrant or other remedy provided by law to secure entry, no owner or occupant or any other person having charge, care, or control of any building or premises shall fail or neglect, after proper request is made to promptly permit entry by the Zoning Inspector for the purpose of inspecting and examining the building or premises.
   (e)    Nothing herein shall be construed to prohibit entry of any authorized official at any time when an actual emergency or the possibility for immediate danger to the public safety exists. (Ord. 2009-08. Passed 4-6-09.)
