925.06 EXTENSION OUTSIDE CORPORATE LIMITS.
   (a)   No sanitary sewer service shall be extended to any sanitary sewer users outside the corporate limits of the Village of Cardington, except under the conditions as set forth in this section.
   (b)   The Village may extend sanitary sewer service to real property which is outside of its corporate limits of the Village, but within the Municipality’s sanitary service area provided that before such sanitary sewer service is extended, the owner of such real property shall:
      (1)   Comply with any comprehensive plan adopted by the Village and currently in effect; and
      (2)   Comply with the zoning regulation of the governmental entity in which the real property is located; and
      (3)   Execute an agreement to annex the property to the Village or a petition for an annexation to the Village, as determined by the Village. Such owner shall exert all efforts to obtain annexation of his or her property as soon as feasible under applicable annexation statutes, including, if requested by the municipality, signing an annexation petition. In the case of an agreement to annex to the Village, the owner of such land must also agree to require a similar agreement from anyone to whom he or she sells all or any part of his or her land subject to the annexation agreement. All costs associated with said annexation shall be the responsibility of the property owner.
For purposes of this provision the sanitary sewer service area shall be those areas currently annexed as part of the Village and such additional areas as the Village shall determine to be in the best interest of the Village to provide sanitary sewer service. In the event a sanitary sewer district is established by the Village or by another party, the sanitary sewer service area shall be that area which is designated as the sanitary sewer district for the Village and such other areas outside the sewer district as the Village shall determine is in the best interest of the Village.
   (c)   Any sanitary sewer connection permit shall only be issued upon owner’s compliance with subsections (a), (b) and (c) hereof. Evidence of compliance with this section shall be presented to the Village Administrator prior to the issuance of any sanitary sewer service connection permit. (Ord. 2005-09. Passed 2-12-05.)
