905.05 BACKFILL MATERIAL AND METHOD.
   (a)   Where it is necessary to remove any portion of a pavement of any type, driveway or sidewalk for excavation of any sewer, water main, gas pipe or any other service, the trench shall be backfilled with sand, gravel or crushed stone which shall be thoroughly rammed or settled in place in such a manner as to prevent further settlement within the limits of the pavement, driveway or sidewalks. Under certain conditions and upon special permission of the Administrator, the excavated material may be replaced if placed in not more than four-inch layers and thoroughly compacted with pneumatic tampers.
   (b)   Upon failure or refusal of the permitee satisfactorily to fill the excavation, restore the surface and remove all excess materials within the time specified in the permit or where not specified therein, within a reasonable time after commencement of the work, the Village may proceed without notice to make such fill and restoration and file a claim against the maintenance bond issuer. Upon payment of such claim, said payment shall be paid into the street repair fund of the Village. To the extent that the payment exceeds the charges of the Village for services performed by it, the excess funds shall be remitted to the permitee. If the amount of such services performed by the Village should exceed the amount of such payment, the Administrator shall proceed to collect the remainder due from such permitee.
