901.14 NOTICES OF VIOLATION OF NON-COMPLIANCE AND REMEDIES.
   (a)   When any property is in violation of Sections 901.08, 901.09 and/or 901.13 of the Codified Ordinances of the Village of Cardington, the Village Administrator shall issue a notice of Violation to the owner (s), at the last known address of the property owner (s). This notice of violation shall contain an order to conform to the Ordinance alleged to be violated within ninety (90) days.
   (b)   If the property owner (s) does not comply with the order to conform contained in the Notice of Violation, the Village Administrator shall refer the matter to the Village Council to initiate procedures to assess non-complying owners for the cost of repairing or restoring sidewalks.
   (c)   In addition, the property owner (s) shall be liable for all penalties provided under this chapter.
   (d)   Whenever such violation is corrected by the Village at the Village expense, upon completion of the work, the Village shall give thirty (30) days notice to the owner (s) of such premises in violation , at the last know address of such owner (s), to pay all charges incurred. Such statement will include the amount of charges including the following:
      (1)   Administrative/Supervision costs.
      (2)   Transportation of tools and equipment.
      (3)   Equipment and tool rental fees.
      (4)   Equipment operator wages.
      (5)   Incidental labor.
      (6)   Materials provided and cost to deliver such.
      (7)   Legal fees incurred.
   (e)   (1)   If such charges are not paid within thirty (30) days after the mailing of said notice, then Council may enact an ordinance directing the County Auditor of its action under this chapter, with a statement of the approved charges and the amount paid for performing of labor, fees to officers who made the service of the notice and return and a proper description of the premises by legal description (permanent parcel number) for purposes of having said charges added to the real estate tax duplicate. The Village may accept installment payments in special instances at the discretion of the Mayor, but such payments shall not take longer to complete than one (1) year.
      (2)   Such amounts, as approved by Council, shall be entered upon the tax duplicated, and shall be a lien on such land from the date of entry and shall be collected as other taxes and returned to the Village General Fund.
