(A) Persons making discharges of industrial waste into the City of Canton System shall pay a charge to cover all costs of collection and treatment.
(B) When discharges of any waste into the City of Canton system are approved by the approving authority, the city or its authorized representative shall enter into an agreement or arrangement providing:
(1) Terms of acceptance by the city;
(2) Payment by the person making the discharge, in accordance with the user charge system as established by the approving authority;
(3) Sewer connection procedures and requirements shall be in accordance with the Uniform Plumbing Code as promulgated by the International Association of Plumbing and Mechanical Officials;
(4) A sewer application approved with connection fee paid; and
(5) Construction of sewer connections shall be approved by City Inspectors prior to sewer use.
(C) If the volume or character of the waste to be treated by the city requires that wastewater collection, treatment or other disposal facilities of the city be improved, expanded or enlarged in order to treat the waste, then prior to approval, the city and the person making the discharge shall enter into an agreement which provides that the discharger pay in full all added cost the city may incur due to the acceptance of the waste.
(D) The agreement entered into pursuant to division (B) above shall include but not be limited to:
(1) Amortization of all capital outlay for collecting and treating the waste, including new capital outlay and the proportionate part of the value of the existing system used in handling and treating the waste; and
(2) Operation and maintenance costs including salaries and wages, power costs, costs of chemicals and supplies, proper allowances for maintenance, depreciation, overhead and office expense.
(E) If it is determined by the approving authority that the volume or character of the waste to be treated by the city does not require that wastewater collection, treatment or other disposal facilities of the city be improved, expanded or enlarged in order to treat the waste, then the user charge shall consist of a base charge plus a surcharge to distribute operation and maintenance costs and bond service costs to each user in proportion to his contribution to the total wastewater loading of the treatment plant. The base charge shall be equivalent to the minimum basic charge for commercial sewer. The surcharge will be levied when B.O.D. and total suspended solids (T.S.S.) concentrations from a user exceed a base level of 500 mg/l for each, according to the following formula:
