§ 112.13  ENFORCEMENT.
   (A)   Enforcement of this subchapter shall be implemented by the City Manager or his or her designee.
   (B)   Any citizen who desires to register a complaint under this subchapter may initiate enforcement with the City Manager or his or her designee.
   (C)   It is the responsibility of the owner, manager, operator or employee of any establishment regulated by this subchapter to inform persons violating this subchapter of the provisions herein.
   (D)   It is the responsibility of the owner, manager, operator or employee of any establishment regulated by this subchapter to enforce the regulations of this subchapter at their establishment. Refusal by the owner, manager, operator or employee of the establishment to enforce the regulations of this subchapter shall cause the owner, manager, operator or employee to be guilty of an infraction and subject to penalty. In the event patron(s) of an establishment regulated by this subchapter fail to adhere to this subchapter, the owner, manager, operator or employee shall contact the Canton Police Department.
   (E)   Notwithstanding any other provision of this subchapter, a private citizen may bring legal action to enforce this subchapter.
   (F)   No person or employer shall discharge, refuse to hire or in any manner retaliate against any employee or applicant for employment because such employee or applicant exercises any right to a smoke-free environment.
