(A) The City Council hereby restricts the use of any motor brake within the City of Canton in an attempt to reduce noise, prevent destruction of pavement at intersections and facilitate lower speeds within the downtown traffic corridors.
(B) This section shall be strictly enforced by the City of Canton Police Department.
(C) Any person violating this section may be cited and, upon conviction thereof, shall be punished by a fine of not less than $50 nor more than $200 for each offense.
(D) All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of the conflict.
(E) If for any reason any section, division, clause, phrase, word or provision of this section, shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not effect any other section, division, clause, phrase, word or provision hereof given full force and effect for its purpose.
(F) The City Manager of the City of Canton is hereby authorized and directed to cause a true and correct copy of the caption, penalties and effective date of this section to be published in a newspaper having general circulation in the City of Canton, Texas prior to its effective date. Following the publication and posting of signs, this section shall be in full force and effect.
