(A) All solid fuel-fired devices/outdoor furnaces operated or installed within the city limits are required to meet the safety and emissions standards required by the Environmental Protection Agency (EPA) and Underwriters Laboratories (UL) listing.
(B) All solid fuel-fired devices/outdoor furnaces operated or installed within the city limits are subject to regulation as public nuisances as described in this subchapter.
(C) Dense smoke, noxious fumes, gas and soot or cinders, in unreasonable quantities, are declared a public nuisance and are hereby made subject to regulation and control by a properly designated authority.
(D) Every solid fuel-fired device/outdoor furnace shall have a minimum chimney stack height of 20 feet from ground level and a minimum of two feet above the roof line of the highest structure within 200 feet. A freestanding outdoor furnace must be setback a minimum of 40 feet from all property lines and a minimum of ten feet from any principal or accessory structure. Construction of all stacks or chimneys must be of masonry or insulated metal.
(E) All stacks or chimneys on solid fuel-fired devices/outdoor furnaces must be so constructed to withstand wind and snow loads per the current State Building Code.
(F) An outdoor furnace shall not be used between April 15 and October 15 of each year.
