For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning. The meaning of words and terms used in this subchapter but not defined in this section usage shall be determined in the following order: as defined in § 152.021 of the city code, as defined elsewhere in the city code, as defined in the state statutes, the commonly used and accepted meaning.
OUTDOOR FURNACE. Any equipment, device or apparatus, or any part thereof, which is installed, affixed or situated outdoors for the primary purpose of combustion fuel to produce heat or energy used as a component of a heating system providing heat for any interior space or water source. It is the intent of this subchapter to regulate only exterior freestanding solid fuel-fired devices and solid fuel-fired devices which are contained within a structure primarily designed or used to house the solid fuel device.
PERSON. An individual, partnership, corporation, company or other association.
PUBLIC NUISANCE. An act or failure to perform a legal duty which results in a violation of any of the acts described within this subchapter.
SOLID FUEL-FIRED DEVICE. A device designed for solid fuel combustion. This definition shall not include devices such as fuel-fired stoves, fireplaces, solid fuel-fired cooking stoves and combination fuel furnaces or boilers which burn solid fuel which are located within the confines of a residence or garage. SOLID FUEL-FIRED HEATING DEVICE does not include natural gas-fired fireplace logs.
STACKS or CHIMNEYS. Any vertical structure, whether or not incorporated into a building, enclosing a flue or flues that carry off smoke or exhaust from a solid fuel-fired heating device or the part of a structure extending above a roof.
