§ 117.03 ELIGIBLE APPLICANTS AND EXCEPTIONS.
   (A)   No license shall be granted to a person who has not been the owner of the business owning the goods, and conducting the sale, for at least six months prior to the date of application, provided, that this division shall not apply to heirs, devisees, legatees or personal representatives of the owner.
   (B)   No license shall be granted at the same location within the period of two years.
   (C)   No license shall be granted to a person who has been convicted of violating any provisions of this chapter within five years prior to the application.
   (D)   The provisions of this section shall not apply to sales made by public officials in the performance of their duties or by persons acting pursuant to a court order or legal process.
