In case the owner of record or the purchaser under a land contract shall fail, neglect or refuse to comply with the notice to repair, rehabilitate or demolish and remove such building or structure or portion thereof, such party shall be subject to penal provisions herein and the Fire Chief shall proceed to have the building or structure or portion thereof demolished and removed from the premises, leaving the premises in a clean, safe and sanitary condition and the total cost of such work shall be paid by the City. If the City is not reimbursed for such costs within ten days of the notice, the amount thereof shall be certified to the County Auditor and levied as a special assessment against such property on which the building or structure is located and shall be collected as other taxes and returned to the City, all in accordance with Ohio R. C. 715.26.1. The City may also commence civil action to recover total costs.
