521.12 WEEDS.
   (a)   Written notice that noxious weeds are growing on lands in Canal Winchester, Ohio that are about to spread or mature seeds, shall be served upon the owner, lessee, agent, or tenant having charge of such land, notifying him that noxious weeds are growing on such lands and that they must be cut and destroyed within five days after the service of such notice. If the owner or other person having charge of such lands is a non-resident whose address is known, such notice shall be sent to his address by certified mail. If the address of such owner is unknown, it shall be sufficient to publish such notice once in a newspaper of general circulation in the County.
   (b)   If the owner, lessee, agent or tenant having charge of the lands mentioned herein fails to comply with the notice required by such section, the Municipality may cause such noxious weeds to be cut and destroyed and may employ the necessary labor to perform such task. All expenses incurred shall, when approved by Council, be paid out of any money in the treasury of the municipal corporation not otherwise appropriated.
   (c)   The Clerk of Council shall make a written return to the County Auditor of action taken under these sections, with a statement of the charges for its services, the amount paid for the performing of such labor, the fees of the officers who made the service of the notice and return, and a proper description of the premises. Such amounts, when allowed, shall be entered upon the tax duplicate, shall be a lien upon such lands from the date of the entry, and shall be collected as other taxes and returned to the Municipality with the General Fund.
   (d)   Any person owning or having charge of land within Canal Winchester shall keep said property free and clear from all noxious weeds and rank vegetation and shall be required to cut all such weeds and vegetation on the lots owned or controlled by him at least twice in every year, once between the 1st of May and the 1st of June and once between the 15th of July and the 15th of August.
   (e)   Whoever shall violate or fail to comply with the provisions herein provided shall be guilty of a minor misdemeanor.
