(a) Pursuant to Section 7.04 of the Charter of the City of Canal Winchester, as amended, there is hereby created a Personnel Board of Review consisting of three electors of Canal Winchester, not holding other office, appointment or employment with Canal Winchester. Members shall be appointed by the Mayor subject to confirmation by Council by a majority vote of the Council for a term of three years, except that of the three members of the Board first appointed, one shall be appointed for a term of one year, one for a term of two years, and one for a term of three years, all commencing the first day of January following their appointment, unless otherwise specified at the time of appointment. A vacancy occurring during the term of any member of the Personnel Board of Review shall be filled through an appointment by the Council for the unexpired term. The Board shall designate one of its members as chair and may appoint a Clerk who need not be a member of the Board and may hold other Municipal office or appointment, as set forth in the Charter Section 7.04, as amended.
(b) The Personnel Board of Review shall prescribe, amend, and enforce rules consistent with the City Charter and Ordinances of Council:
(1) Hear appeals from administrative determinations made pursuant to the Code of Personnel Practices, as may be authorized by the Code. For example, to hear appeals of employees in the classified service from final decisions of appointing authorities relative to a reduction in pay or position, job abolishment, layoff, suspension, discharge, reclassification or reassignment. The Board may affirm, disaffirm or modify the decision of the appointing authorities. Such decision of the Board is appealable through the court systems pursuant to applicable law.
(2) Exercise the powers and duties as may be given to the Board by ordinance or resolution of Council.
(3) To prescribe, amend and enforce rules consistent with the Charter of Canal Winchester, Ohio and ordinances of Council for the purpose effecting appointments and promotions in the classified service according to merit and fitness, for removals, transfers, layoffs, suspensions, reductions or reinstatements, therein.
(4) To review and approve eligibility lists once they have been created and prior to the selection of the candidate for the classified position.
(5) To, at the Board’s discretion, terminate any eligibility list that has been in effect for more than six (6) months, or as requested by the appointing authority.
(6) To subpoena and require the attendance and testimony of witnesses and the production of books, papers, public records and/or other documentary evidence pertinent to any matter which the Board has the authority to investigate regarding the enforcement of civil service and the enforcement of these Rules.
