(a) The term "transient" as used in this section shall refer to:
(1) Any vehicle parked or stored in an off-street parking area of any office building, retail store or shopping center while the owner(s) and/or occupant(s) are off-premises; or
(2) Any vehicle stopped, resting, or idling, in an off-street parking area of any office building, retail store or shopping center for the purpose of the occupant using the lot to rest or sleep in or near the vehicle.
(b) The term "commercial vehicle" means any vehicle which is used primarily for commercial purposes and not for personal or recreational purposes. The term "commercial vehicle" includes, but is not limited to, any motor vehicle or trailer that is registered with the Ohio Bureau of Motor Vehicles as a commercial motor vehicle or commercial trailer pursuant to Chapter 4503 of the Ohio Revised Code, or any vehicle that has been recognized as such by any other state bureau of motor vehicles. The term "commercial vehicle" includes, but is not limited to, any vehicle that qualifies under the definition of "commercial motor vehicle" pursuant to Ohio R.C. 4506.01(D).
The term "commercial vehicle" does not include a vehicle associated with a legally established home occupation, a vehicle with a GVWR (Gross Vehicle Weight Rating) less than ten thousand pounds (10,000 lbs.), or any vehicle required to respond on an emergency basis for the public health, safety, and welfare.
(c) No person shall park any transient commercial vehicle in the off-street parking area of any office building, retail store or shopping center.
