The 2003 edition of the International Property Maintenance Code is hereby adopted as the Canal Winchester Property Maintenance Code excepting the following provisions which shall read as set forth below:
(a) 101.3 Replace International Building Code with Ohio Building Code or Residential Code of Ohio for One, Two and Three Family Dwellings, hereinafter referred to as Residential Code of Ohio.
(b) 102.1 Replace the 2nd sentence with the following: Where different sections of this Code, or the Canal Winchester, Ohio Zoning Code, hereinafter referred to as Zoning Code, specify different requirements, the most restrictive shall govern.
(c) 102.3 Replace the International Existing Building Code with Ohio Building Code or Residential Code of Ohio.
(d) 102.3 Replace International Zoning Code with Zoning Code.
(e) 102.7 Delete this section.
(f) 103 Change Title to Planning and Zoning Department.
(g) 103.1 Replace with the following: The Planning and Zoning Department is responsible for the administration of this code and the Planning and Zoning Administrator shall be known as the Code Official.
(h) 103.5 Add Inspection Fee of $42.00, to be charged only if a violation is found. If a further inspection is required for non-compliance after initial notification, additional inspection fee of $60.00 shall be charged.
(i) 107.1 Replace “person responsible” with “property owner.”
(j) 110.1 Replace “insanitary” with “unsanitary.”
(k) 111.1 Replace “Board of Appeals” with “Planning and Zoning Commission.”
(l) 111.2 Delete this section.
(m) 111.3 Replace “20 days” with “30 days.”
(n) 111.4 Delete the last sentence.
(o) 111.4.1 Delete this section.
(p) 111.6 Replace board with “Planning and Zoning Commission.”
(q) 201.3 Replace “International Building Code, International Fire Code, International Zoning Code, International Plumbing Code, International Mechanical Code, International Existing Building Code, and ICC Electrical Code” in this section and through the remainder of the code with “Ohio Building Code or Residential Code of Ohio, Ohio Fire Code, Zoning Code, Ohio Plumbing Code, Ohio Mechanical Code, National Electric Code.”
(r) 202 Definition of Blight: An area characterized by deteriorating and/or abandoned buildings; inadequate or missing public or community services; and vacant land with debris, litter, lack of sanitation facilities, trash, and junk accumulation, and impacted by adverse environmental nuisances, such as noise, heavy traffic and odors.
(s) 202 Definition of Code Official: Replace “official who” with “Planning and Zoning Administrator.”
(t) 302.4 Insert “eight (8) inches” in the 1st sentence.
(u) 302.4 In paragraph 2, replace last sentence with the following: “Upon failure to comply with the notice of violation, any duly authorized employee of the jurisdiction or contractor hired by the jurisdiction shall be authorized to enter upon the property in violation and cut and destroy the weeds growing thereon. All expenses incurred shall be documented. The Clerk of Council shall make a written return to the County Auditor of action taken under this section, with a statement of the charges for its services, the amount paid for the performing of such labor, the fees of the officers who made the service of the notice and return, and a proper description of the premises. Such amounts, when allowed, shall be entered upon the tax duplicate, shall be a lien upon such lands from the date of the entry, and shall be collected as other taxes and returned to the municipality with the General Fund.”
(v) 304.14 Insert “May to October”.
(w) 602.3 Delete “during the period from [DATE] to [DATE].”
(x) 602.4 Delete “during the period from [DATE] to [DATE].”
