(a) All sexually oriented businesses shall be closed between 2:30 a.m. and 1:00 p.m. on Sunday and further, shall not be operated between the hours of 2:30 a.m. and 9:00 a.m. Monday through Saturday, provided that, a sexually oriented business which has obtained a license to sell alcoholic beverages from the State of Ohio may remain open pursuant to the terms of that license but may not conduct sexually oriented entertainment activity after 2:30 a.m.
(b) No sexually oriented business shall be operated in any manner that permits the observation from outside the premises of any material, entertainment, merchandise, pictures, advertisements, displays or signs describing specified sexual activities or specified anatomical areas or any person in a state of nudity or semi-nudity.
(c) No person shall operate or cause to be operated a sexually oriented business and knowingly, or with reasonable cause to know, permit, suffer or allow a person who is younger than eighteen years of age to enter or be on the premises at any time the business is open.
(d) It shall be the duty of the operator of a sexually oriented business to ensure that an attendant is stationed at each public entrance to the business during such business's regular business hours. It shall be presumed that an attendant knew a person was under eighteen years of age unless such attendant asked for and was furnished a valid motor vehicle operator's license or valid personal identification card issued by the State of Ohio.
(e) Whoever knowingly violates this section is guilty of a misdemeanor of the first degree.
