(A) Definition. For the purposes of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
LOOSE GRASS AND OTHER YARD DEBRIS. The cuttings, clippings, or trimmings from grass, shrubbery, vines, flowers, leaves, trees, or other natural materials which result from the care, maintenance, or neglect of the real estate within the city.
(B) Requirements.
(1) No person shall deposit or discard grass, shrubbery, vines, branches, limbs, leaves, cuttings and other grass/yard clippings or naturally created materials resulting from the care or maintenance of real property onto the street, sidewalk or other public right-of-way.
(2) Leaves and grass shall be placed in substantial containers, or otherwise contained on the property from whence they came.
(3) The owner and/or occupant of the property at the sidewalk and/or street where any grass shrubbery, vines, branches, climbs leaves, cuttings and other excess grass/yard clippings or naturally created materials may be, is responsible for the cleanup and removal of same.
(C) Penalty. Citations issued by the Property Code Enforcement Officer that are not appealed or which are upheld by the Board or any court of proper jurisdiction shall be subject to the following schedule of civil penalties for each violation:
(1) First offense: Warning;
(2) Second offense: $100;
(3) Third and subsequent offenses: $250.
