In cases of residential, commercial or industrial rental properties, the property owner and the tenant or occupant shall be jointly responsible for payment of bills for utilities. The Village Clerk-Treasurer shall first attempt to collect the bill from the tenant, and if payment is not voluntarily made by the tenant, then the Village Clerk-Treasurer may look to the property owner for payment. The tenant or occupant’s service deposit and any other payments shall be first applied to the account before collection of the account balance from the property owner. In case of delinquency, the property owner shall be provided a copy of the notice of delinquency and notice of intent to terminate service required herein. Unpaid accounts for water, sewer, electricity and solid waste collection services may still be filed as liens against the property as provided herein and the property owner shall be provided copies of all notices required in those sections. In case of delinquency that falls on the property owner’s responsibility to pay after exhausting all attempts to collect from the tenant, the village has the right to disconnect utility service to that property until such time as all accounts are paid in full pursuant to the village’s ordinance concerning reconnect of delinquent accounts.
