509.08  LOUD AND DISTURBING NOISES.
   (a)   The creation of any loud, disturbing and unnecessary noise in the City is prohibited.
   (b)   The following acts, among others, are declared to be loud, disturbing and unnecessary noises in violation of this section, but this enumeration shall not be deemed to be exclusive:
      (1)   The sounding of any horn or signal device on any automobile, motorcycle, bus or other vehicle while not in motion, except as a danger signal if any vehicle is approaching apparently out of control, or in motion only as a warning signal reasonably necessary for the preservation of accidents.
      (2)   The use of any gong or siren upon any vehicle other than a police, fire or other public safety vehicle.
      (3)   The use of any automobile, motorcycle or vehicle so out of repair, loaded or in such manner as to create loud or unnecessary grating, grinding, rattling or other noise.
      (4)   The creation of a loud and excessive noise in connection with loading or unloading any vehicle.
      (5)   The use of any drum, loud speaker or other instrument or device for the purpose of attracting attention by the creation of noise to any performance, show or sale or display of merchandise.
      (6)   The use of loud speakers or amplifiers on trucks or other vehicles for advertising or other purposes.
      (7)   The creation of any noise on any street adjacent to any church, school, institution of learning or court while the same are in session, or adjacent to any hospital.
      (8)   The conducting, operating or maintaining of any garage in any residential district so as to cause loud or offensive noises to be emitted therefrom anytime between 11:00 p.m. and 7:00 a.m. so as to disturb or keep awake persons residing in the immediate vicinity.  “Residential district” used in this paragraph, applies to any garage located within one hundred feet of any building or buildings used as a private residence, rooming house, apartment or hotel.
      (9)   The conducting, operating or maintaining of any bar, night club, or other place of business where beer, wine or intoxicating liquor is sold, or any kind of business, in any residential district so as to cause or permit loud offensive noises to be emitted therefrom at any time between 11:00 p.m. and 8:00 a.m. so as to disturb or keep awake persons residing in the immediate vicinity.  “Residential district” as used in this subsection shall apply to any place of business where beer, wine or intoxicating liquor is sold, restaurant, or any other kind of business in any residential district or located within one hundred feet of any building used as a private residence apartment house or rooming house.
   (c)   No person shall while operating or is in possession of a motor vehicle on a public street or on private property in a residential district shall allow a radio or cassette player to play in an unreasonably loud or offensive manner.  Residential district as used in this paragraph applies to any garage located within one hundred feet of any building or buildings used as a private residence. 
   (d)   No person who operates or is in possession of a motor vehicle shall make, continue to cause to be made from their vehicle, or continued any loud, unnecessary or unusual noise or any noise which either annoys, disturbs, injures or endangers the comfort, health, peace or safety of others within the City.
   (e)   Whoever violates this section is guilty of a minor misdemeanor for the first offense.  Second offense within three years is guilty of a misdemeanor of the fourth degree.
