351.99  PENALTY.
   (EDITOR'S NOTE:  See Section 303.99 for misdemeanor classifications and penalties.)
   (a)   General Penalty.  Whoever violates any provision of this chapter where another penalty has not been specifically established, shall, for the first offense, be fined not more than one hundred dollars ($100.00); for a second offense within one year after the first offense, such person shall be fined not less than ten dollars ($10.00) nor more than one hundred dollars ($100.00); for each subsequent offense within one year after the first offense, such person shall be fined not less than twenty-five dollars ($25.00) nor more than two hundred dollars ($200.00).
   (b)   Parking in Handicapped Location.  Whoever violates Section 351.04 (f) shall be fined not less than two hundred and fifty dollars ($250.00) nor more than five hundred dollars ($500.00), but in no case shall an offender be sentenced to any term of imprisonment.  Arrest or conviction for a violation of Section 351.04 (f) does not constitute a criminal record and need not be reported by the person so arrested or convicted in response to any inquiries contained in any application for employment, license, or other right or privilege, or made in connection with the person’s appearance as a witness.  (ORC 4511.99)
   (c)   Courtesy Fines for Minor Parking Violations.  The owner or operator of an illegally parked vehicle may pay to the Municipal Court a courtesy fine of twenty-five dollars ($25.00) payable within two days, from two days to thirty days the fine shall be thirty-five dollars ($35.00) and after thirty days said fine shall be fifty dollars ($50.00), provided the owner or operator signs a waiver of jurisdiction and consents to the payment of the nominal fine.  The owner or operator of such illegally parked vehicle shall have the privilege of refusing to sign any waiver of jurisdiction and to have his case set for hearing in the Municipal Court.  Failure of such owner or operator to make such payment to the Municipal Court within twenty-four hours may render such owner or operator subject to the penalties provided for the violation of the provisions of this chapter.
