(a) The Director of Finance is hereby granted authority in the name of the City of Campbell to participate in State Contracts which the Ohio Department of Transportation, Office of Contracts has distributed or entered into for the purchase of machinery, material, supplies, or other articles pursuant to Ohio R.C. 5513.01(B).
(b) The Director of Finance is hereby authorized to agree in the name of the City to be bound by all contract terms and conditions as the Ohio Department of Transportation, Office of Contracts prescribes for the current year and future years, until revoked or repealed.
(c) The City through the Director of Finance does hereby agree to be bound by all such terms and conditions of the contract(s); and to be responsible for the payment directly to the vendor(s) for quantities purchased under the contract(s).
(d) The City agrees to hold the Director of Transportation and the Ohio Department of Transportation harmless for any claim or dispute arising out of participation in a contract pursuant to Ohio R.C. 5513.01(b).
(e) The funds to pay for obligations have been previously appropriated in the Street Fund and State Highway Fund, and that funds are appropriated annually in the same funds to pay for these obligations. (Res. 07-0705. Passed 11-14-07.)
