1311.10  DESIGNATION OF UNFIT DWELLINGS AND STRUCTURES AND LEGAL PROCEDURE OF CONDEMNATION.
   (a)   The Director of Administration or his designee shall condemn and placard as unfit for human habitation a dwelling, structure, or dwelling unit which:
      (1)   Is of damaged, decayed, dilapidated, unsanitary, unsafe or vermin-infested that it creates a serious hazard to the health or safety of the occupants or of the public; or
      (2)   Lacks illumination, ventilation, or sanitation facilities adequate to protect the health or safety of the occupants or of the public.
   (b)   Any dwelling, structure, or dwelling unit condemned and placarded as unfit for human habitation shall be vacated within a reasonable time as ordered by the Director of Administration or his designee.
   (c)   No dwelling, structure or dwelling unit condemned and placarded as unfit for human habitation shall again be used for habitation until written approval is secured from, and the placard is removed by the Director of Administration or his designee.  The Director of Administration or his designee shall remove the placard when the defect or defects upon which the condemnation and placarding action were based have been eliminated.
   (d)   No person shall deface or remove the placard from any dwelling, structure or dwelling unit which has been condemned as unfit for human habitation except as provided in subsection (c) hereof.
   (e)   Any person affected by a notice or order relating to the condemning and placarding of a dwelling or dwelling unit as unfit for human habitation may request and shall be granted a hearing on the matter before the Director of Administration or his designee under the procedure set forth in Section 1311.09.
   (f)   The Director of Administration or his designee may certify any dwelling, structure or dwelling unit which has been condemned and placarded to the Building Inspector to be demolished in accordance with the procedures provided in the Code of the City of Campbell City Ordinances and the Ohio Basic Building Code.
   (g)   The Ohio Basic Building Code is hereby adopted by reference as part of this chapter.  (Ord. 80-7447.  Passed 6-18-80.)
