1311.04 MINIMUM SPACE, USE AND LOCATION REQUIREMENTS.
   No person shall occupy or let to another for occupancy any dwelling or dwelling unit, for the purpose of living therein, which does not comply with the following requirements:
   (a)   Every dwelling unit shall contain at least 150 square feet of floor space for the first occupant thereof and at least 100 additional square feet of floor space for every additional occupant thereof, the floor space to be calculated on the basis of total habitable room area.
   (b)   Every room used for sleeping purposes shall contain at least 70 square feet of floor space; if occupied by more than one person.  Every room used for sleeping purposes shall contain at least 50 square feet of floor space for each occupant.
   (c)   A habitable room shall have a ceiling height of at least 7 ½ feet.  Where there is a sloping ceiling at least one half of the floor area shall have a ceiling height of not less than 7 feet; the floor area of that part of any room where the ceiling height is less than 5 feet shall not be considered as part of the floor area in computing the total floor area of the room for the purpose of meeting the requirements of this chapter.
   (d)   No room in any basement or cellar shall be occupied as a habitable room except  as a workroom or recreation room unless:
      (1)   The clear inner ceiling height is at least 7 ft. 6 inches;
      (2)   The uppermost 3 feet of the required clear inner height is above the average outside ground level;
      (3)   The required minimum window area is located entirely above the grade of the ground adjoining such window area;
      (4)   The floors and walls are water and damp proof in accordance with an approved method; and
      (5)   There is a safe and unobstructed means of egress.
   (e)   Access to a dwelling unit in a multiple dwelling shall be had without passing through any part of another dwelling unit.  (Ord. 80-7447.  Passed 6-18-80.)
