1311.02  MINIMUM STANDARDS FOR SANITARY EQUIPMENT AND FACILITIES.
   No person shall occupy as owner or let to another for occupancy any dwelling or dwelling unit, for the purpose of living, sleeping, cooking or eating therein, which does not comply with the following requirements:
   (a)   Every dwelling unit shall contain a kitchen sink in good working condition and properly connected to a water and sewer system approved by the Director of Administration or his designee and Building Inspector.
   (b)   Every dwelling unit, except as otherwise permitted under subsection (c) hereof shall contain, within a separate room or rooms affording privacy, a flush water closet, a lavatory basin, and a bathtub or shower.  These fixtures shall be in good working condition and properly connected to a water and sewer system approved by the Director of Administration or his designee.  Such room shall not be used for the preparation or consumption of food or for sleeping purposes and shall be accessible without passing through a sleeping room or another dwelling unit.
   (c)   (1)   The occupants of not more than two dwelling units where the two units were created before the adoption of this chapter may share a flush water closet, a single lavatory basin, and a single bathtub or shower if the total number of occupants is not more than eight.  Such water closet, lavatory basin, and bathtub or shower shall be in good condition and properly connected to a water and sewer system approved by the Health Officer.
      (2)   Where the construction of a dwelling is commenced on or after the date of the enactment of this chapter, every dwelling unit within the dwelling shall be provided with at least one kitchen sink, one flush water closet, one lavatory basin and one bathtub or shower.  The date of commencement of construction shall be the date of the issuance of a building permit by the Department of Building Inspection.
   (d)   Every kitchen sink, lavatory basin, and bathtub or shower required under the provisions of this Section shall be properly connected with both hot and cold water lines.
   (e)   Every dwelling shall have water heating facilities which are properly installed, are maintained in safe and good working condition, and properly connected with the hot water lines required under the provisions of this section, and are capable of heating water to such a temperature as to permit an adequate amount of water to be drawn at every required kitchen sink, lavatory basin, bathtub or shower at a temperature of not less than 120 degrees F. at all times.
