A vacancy for the purpose of this Charter shall be defined as an elected or appointed position or office that is unfilled or unoccupied and to which:
(1) The person last holding that position is currently not occupying and
(2) The person last holding that position is not planning on or expected to return to that position.
For the purpose of this section, any elected or appointed position from which the person last holding that position dies, retires, resigns, or is terminated shall be considered a vacancy of that position.
An absence for the purpose of this Charter shall be defined as any elected or appointed position for which the person occupying said position is not currently occupying the position, but has the intention and right of resuming said position. An absence may be due to, but not limited to, absences for health reasons. (Enacted 11-7-06)
