(a) The purpose of this section is to establish regulations for the disposal, by private haulers of delivery to the Campbell Waste Water Treatment Plant of wastes from septic tanks and from privately owned and operated package sewage treatment plants, and to fix charges for the acceptance and treatment thereof.
(b) As a prerequisite for obtaining permission to dispose, by private hauler to the Campbell Waste Water Treatment Plant, of wastes from septic tanks or from privately owned and operated package sewage treatment plants, each hauler of such wastes shall obtain a permit to haul sewage tank cleaning waste from the county health department. A copy of this permit shall be on file at the Campbell Waste Water Treatment Plant before it is granted to discharge waste. Haulers of septic tank waste from other counties shall present a permit to haul septic tank wastes from their respective county’s Board of Health, when applying to the County Health Department for its permit to operate and discharge. This permit shall be renewed annually.
(c) All haulers of waste from septic tanks or privately owned and operated package sewage treatment plants, in order to dispose of such wastes at the Campbell Waste Water Treatment Plant, shall first obtain a permit from the County Board of Health for each vehicle used for this purpose, by making application on forms provided therefor by the Health Department and by providing the permit called for in subsection (b) hereof.
(d) The Campbell Waste Water Treatment Plant may refuse the services of its facilities to haulers of septic tank waste or wastes from privately owned and operated package sewage treatment plants delivered by private haulers to Campbell’s treatment facilities for specific loads if the hauler has failed to tender payment for disposal charges within sixty (60) days of the date of billing the department or if the waste material to be delivered to the treatment facility is determined to:
(1) Be deleterious to the treatment facility or appurtenances thereto;
(2) Cause unusual expense in the handling and treatment;
(3) Inhibit the performance of the treatment process;
(4) Cause the plant to fail to meet effluent limits set forth by State and Federal regulatory agencies; or
(5) Contain industrial or scavenger waste.
(e) The Director of Administration or Superintendent of the Campbell Waste Water Treatment Plant may revoke the wastewater disposal permit acquired by haulers of septic tank or waste from privately owned and operated package sewage treatment plants if the hauler:
(1) Misrepresents the nature and source of the wastewater; or
(2) Refuses to allow safety, traffic and disposal directions of the plant operators at the treatment plants; or
(3) Fails to tender payment for disposal charges within sixty (60) days of the date of billing by the City.
(f) The only permitted location for disposal of septic tank waste or other approved wastes is at the Water Pollution Control Treatment Facilities, 4200 Wilson Avenue, Campbell, Ohio at a point designated by the Director of Administration or Superintendent of the Waste Water Treatment Plant. Hours of operation shall be established by operational considerations of the facility and haulers shall be so notified. No waste shall be discharged into any sewer, manhole, catch basin or any appurtenance thereto or into any natural watercourse.
(g) All haulers of septic tank waste or waste from privately owned and operated package plants are required to report to the Campbell Waste Water Treatment Plant information pertaining to the source of such waste. This information shall be submitted by the haulers on such forms as may be issued by the Superintendent of the Campbell Waste Water Treatment Plant.
(h) That treatment charges for septic tank waste or waste from privately owned and operated package sewage treatment plants shall be the following:
A minimum of fifty dollars ($50.00) for each load delivered to the treatment plant for treatment or a charge of five cents ($.05) per gallon for each load with a volume greater than 1,000 gallons. The tank size of the truck shall determine gallonage charge over 1,000 gallons regardless of volume in the tank at the time of discharge. These charges shall be reviewed annually and adjusted as necessary.
(I) A minimum of one hundred fifty dollars ($150.00) for each load delivered to the treatment plant for treatment or a charge of fifteen cents ($.15) per gallon for each load with a volume greater than 1,000 gallons. The tank size of the truck shall determine gallonage charge over 1,000 gallons regardless of volume in the tank at the time of discharge. All water shall be lab certified to be nondetectable of any hazardous or toxic pollutants. These charges shall be reviewed annually and adjusted as necessary.
(k) All haulers of waste from septic tanks or privately owned and operated package sewage treatment plants using the services and facilities of the City of Campbell’s Waste Water Treatment Plant pursuant to the licensing requirements set forth hereinabove, shall be responsible for, and shall reimburse the City, in full, for any charged fines, costs, or other monetary assessments, including attorney fees, levied against the City by local, state or federal governing agencies including, but not limited to, the State of Ohio EPA and/or the United States EPA, as a result of the City having been found to have improperly or illegally received, handled, or discharged effluent or waste received from a private hauler. The private hauler shall be responsible for reimbursement to the City only to the extent that any improper or illegal receipt, handling or discharge of effluent or waste is directly traceable to effluent or waste brought by the private hauler to the City’s Waste Water Treatment facility for treatment.
