901.02  CURBINGS, GUTTERS AND SIDEWALKS.
   (a)   Curbings, Gutters and Sidewalks Required.  Curbings, gutters and sidewalks shall be installed in all areas within the City.
   (b)   Installation.  In those areas within the City not presently having curbings, gutters and sidewalks, such curbings, gutters and sidewalks shall be installed in accordance with specifications herein set forth.
   (c)   Inspection.  In those areas within the City which presently have curbings, gutters, and sidewalks, such curbings, gutters and sidewalks shall be subject to inspection by and approval of the Director of Administration.
   (d)   Plans and Specifications.  The plans and specifications for the necessary character of the workmanship and the kind and quality of the materials to be used in the making and construction of sidewalks, curbings and gutters shall be provided and kept at all times by the Service Director in his office, open to public examination.
   (e)   Notice to Owner; Cost may Constitute Lien. 
      (1)   Council shall cause each property owner affected by this chapter to be served with notice, according to law.  If, within fifteen days after such service of notice, such curbing, gutter, and sidewalk has not been constructed or repaired, the City shall have the right to let contract for such construction or repair.
      (2)   The cost of such construction or repair shall constitute a lien on the property abutting such curbing, gutter and sidewalk from the date it is reported to owner and shall be paid by him to the City Treasurer.
      (3)   If the cost is not paid within ninety days from the time it is reported to such owner, the City Clerk shall certify it, with a forfeiture of five percent (5%) thereon, to the County Auditor, who shall place it on the tax duplicate and collect such costs and forfeitures in the same manner as other taxes are collected.
   (f)   Dimensions of Curbings and Gutters.
      (1)   Curbings and gutters shall have fifteen inch aprons with a minimum thickness of five inches.  They shall be poured monolithic in one layer of concrete having compressive strength of 3,500 pounds and having a minimum of six sacks of cement per cubic yard mixed with clean, sharp sand or gravel.  All edges shall be thoroughly spaded to avoid honeycomb.  The surface shall be worked carefully to bring mortar to the top and finished to a smooth surface with a trowel.  The gutter shall be cut into blocks not more than six feet in length and all edges shall be rounded by using a grooving tool.
      (2)   Bituminous premolded expansion joint one-half inch thick and conforming to section of gutter shall be provided and installed at minimum intervals of 100 feet.
   (g)   Dimensions of Sidewalks.
      (1)   Sidewalks shall have a minimum thickness of four inches and shall be poured in one course of concrete having compressive strength of 3,500 pounds and having minimum of six sacks of cement per cubic yard mixed with clean sand and gravel.  All edges shall be thoroughly spaded to avoid honeycomb and the surface shall be worked carefully to bring mortar to the top and brought to a smooth surface with a wooden float.  The walk shall be cut into blocks not more than five feet in length and shall be not less than five feet in width.
      (2)   All edges shall be rounded by using a grooving tool.
      (3)   Three-eighths premolded expansion joints shall be inserted at intervals of not less than sixty feet.
   (h)   Approval.  All completed work must be inspected and approved by the Director of Administration.
   (i)   Standards of Ohio State Highway Department.  Any material or workmanship not specifically covered herein shall be made to conform to the standard specifications of Ohio State Highway Department of this date for similar type work to accepted practice in other locations.
   (j)   Sidewalk Construction; Permit, Fee. 
      (1)   Any person, firm or corporation desiring to install or construction public sidewalks, new or replaced, on any premises within the City shall secure a permit therefore from the Director of Administration and shall at the time the permit is issued, pay the fee required herein.
      (2)   The City, the County, the State, the United States of America, Township Trustee and Board of Education shall be exempt from the paying of any sidewalk inspection or permit fees.
      (3)   The fee for the permit shall be one dollar ($1.00) to five dollars ($5.00).
   (k)   Lowering of Grade Prohibited.  No depression or lowering of the level or grade of such sidewalks shall be recognized or permitted for the purpose of making or constructing a driveway or entrance to private or public property or premises bounding or abutting on such street from the roadway thereof.
   (l)   Notice to Director of Administration; Supervision of Work.  No person, property owner, agent or contractor, under any ordinance or resolution of Council, or otherwise, shall being or proceed to make any such sidewalks in any street of the City, either by private or public contract or agreement until he shall have first notified the Director of Administration of his intention so to do, and thereafter such sidewalk shall be made and constructed under the supervision and control and to the satisfaction and approval of said Director, and no person shall be required by public assessment or otherwise, to pay the cost and expense of making and constructing such sidewalk until the same shall be accepted and approved by said Director in writing.
   (m)   Grade, Construction Specifications.  All sidewalks shall correspond with the line and grade of the street or alley, and shall be laid upon an incline slope rising from the curbstone or outer edge of the sidewalks at a rate not exceeding one-fourth of an inch to the foot, and shall be paved in accordance with the general plan and specifications for sidewalks, and to the satisfaction of the Director of Administration, unless special plans and specifications be ordered by resolution of Council and notice thereof be served upon the owner, when such special plans and specifications shall be followed.  (1973 Code § 97.05 to 97.17)
