§ 174.03 CREMATION OF INDIGENT REMAINS.
   (A)   A sum of money as and for cremation expenses shall be allowed to be paid by the Village to or for the benefit of the estate of persons who die indigent while having a permanent residency in the Village, provided the Village is obligated to do so under Section 9.15/5101.52.1 of the Ohio Revised Code.
   (B)   The sum referred to in division (A) of this section shall not exceed $750 per cremation and shall be used for cremation purposes only. Council reserves the right to modify the $750 by motion as it may from time to time deem fit and proper.
   (C)   The cremated remains may be buried or disposed at the discretion of the family. Prior to the disposition of the cremated remains, the Mayor is authorized to give said cremated remains to the executor, administrator or other court appointed fiduciary of the dead person's probate estate.
   (D)   The word INDIGENT for purposed of this section, means a person dying destitute of property or means of subsistence and without money or credit and who was not gainfully employed at the time of death.
   (E)   All money paid out by the Village under this section shall act as a funeral expense priority claim in the indigent deceased person's estate.
   (F)   The Village of Camden shall determine all questions of indigence or other matters relevant to the executive function of carrying out the terms of this section and shall require the appropriate written proof from the funeral home by a copy of the written application before any payments or final payments are allowed.
