§ 174.01 FILTHY ACCUMULATIONS; DEPOSITS OF GARBAGE AND RUBBISH; CONTAINERS; COLLECTION.
   (A)   No person using, maintaining or being the owner of a dwelling, building, structure or place for a residence or for the exercise of a trade, employment or business, shall cause or allow offal, filth, trash, garbage or noisome substances to be collected or remain in any such place to the damage or prejudice of others or of the public.
   (B)   No person using, maintaining or being the owner of a dwelling, building, structure or place for a residence or for the exercise of a trade, employment or business, shall deposit garbage or trash upon a lot, alley or thoroughfare on or about such place in such form or manner that it may be transferred from that location by wind, flood or other natural causes or forces.
   (C)   All garbage that might cause fumes or dust, constitute a fire hazard or be edible or attractive to rodents, cats, dogs or other animals, or insects, shall be placed outdoors only in closed containers constructed of impervious material which shall be defined to be a solid material which stands erect without support and shall not include paper or plastic bags.
   (D)   Except for those items defined in division (C) of this section, which must be in closed containers, any other materials or objects may be placed outside for trash pick-up without being in closed containers, provided that they are so placed not earlier than 7:00 p.m. on the day prior to the day of scheduled trash pick-up, and provided that they do not remain outside, without being in a closed container, later than 7:00 p.m. on the day of the scheduled trash pick-up. All materials such as paper, cardboard, etc., must be tied in bundles or placed in plastic bags and tied shut.
   (E)   Whoever violates any of the provisions of this section is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. In addition, the violator shall be required by a court of competent jurisdiction to abate or have abated the situation at the violator’s cost and expense.
