The Board is assigned the responsibility of administering all provisions of this chapter as related to construction of new utility infrastructure and shall exercise these responsibilities in accordance with the purpose and intent of this chapter in a fair and objective manner. The Board is assigned the responsibility of administering all provisions of this chapter as related to the operation and maintenance of the District’s utility systems and shall exercise these responsibilities in accordance with the purpose and intent of this chapter in a fair and objective manner. Both may exercise discretion when necessary to administer the provisions of this chapter fairly and responsibly.
