§ 32.82 BOARD OF CONSTRUCTION APPEALS.
   (A)   The Board of Construction Appeals shall consist of five members, having the terms of office for three years, commencing and ending on May 31. The Building Inspector shall sit with the Board and shall act as its Secretary, but shall have no vote.
   (B)   The Board of Construction Appeals shall hear and determine, subject to the rights of appeal hereinafter provided, all matters arising under the Fire Prevention Code, the Building Code, the Electrical Code, and the Plumbing Code. Where any conflicts exist between the provisions thereof such conflicts shall be reconciled by the Board of Construction Appeals. In the application of such codes preference shall be given to the Fire Prevention Code.
   (C)   Any person affected by a decision of the Board of Construction Appeals, may, within five days after a decision, appeal the decision to the Circuit Court; however, the person so appealing shall take no action contrary to such decision pending the decision on appeal. In the event a decision of the Board of Construction Appeals is not appealed within ten days, such decision shall be final.
