11-2-1: MEANINGS OF TERMS OR WORDS:
For the purpose of this title, the following definitions shall apply:
ADMINISTRATOR: An official, having knowledge in the principles and practices of subdividing, who is appointed by the city council to administer this title.
ALLEY: A minor public way providing secondary access at the back or side of a property.
BLOCK: A group of lots, tracts, or parcels within well defined boundaries, usually streets.
BUTT LOT: A lot adjoining another lot, usually behind it.
COMPREHENSIVE GENERAL PLAN: The comprehensive plan for the city officially adopted by the council or current city standards.
COUNTY RECORDER: The office of the county recorder.
CUL-DE-SAC: A dead end street provided with turnaround space at its terminus.
DEDICATION: The setting apart of land or interest in land for use by the public. Land becomes dedicated when accepted by the council as a public dedication, either by ordinance or entry in the official minutes of the council.
DOUBLE FRONTAGE LOT: A lot bordered front and back by a street.
EASEMENT: A right to use, falling short of ownership, granting the right to use the land for specific purposes.
ENGINEER: The city engineer.
HEARING: An advertised public meeting for the hearing of testimony about the merits of the proposed subdivision. Pursuant to Idaho Code section 67-6509, the procedures adopted for the conduct of hearings are to apply to all hearings held pursuant to this title.
HIGHWAY: A street designated as a highway by the state or federal agency responsible therefor.
KEY LOT: A pie shaped lot with the narrow portion adjoining the street.
LOT: A portion of a recorded subdivision intended as a unit for transfer of ownership or for development.
OWNER: An individual, firm, association, syndicate, partnership or corporation having sufficient proprietary interest in land to be subdivided to commence and maintain proceedings under the regulations of this title.
PERFORMANCE BOND: An amount of money or other negotiable security paid by the subdivider or his surety to the city clerk which guarantees that the subdivider will perform all actions required by the governing body regarding an approved plat, and provides that if the subdivider defaults and fails to comply with the provisions of an approved plat, the subdivider or his surety will pay damages up to the limit of the bond, or surety will itself complete the requirements of the approved plat.
PLAT, FINAL: A plan of subdivision, dedication or any portion thereof prepared for filing and recording by the county recorder and containing those elements and requirements set forth in this title. A final plat, upon its being filed and recorded by the county recorder, shall be known as an authorized plat, subdivision or dedication.
PLAT, PRELIMINARY: A preliminary plat of a proposed subdivision or dedication, containing the elements and requirements set forth in this title.
RETURN, PROPERTY LINE: A circular lot line that connects two (2) lot lines at a street intersection.
RIGHT OF WAY: A parcel of land reserved, dedicated, or used for public purposes which normally includes streets, alleys, walkways or utilities.
STANDARD SPECIFICATIONS: The standard specifications for public works of the city officially adopted by the council and including all subsequent amendments thereto.
STREET: A right of way which provides vehicular and pedestrian access to adjacent properties, the dedication of which has been officially accepted by the council. "Street" includes also the terms highway, thoroughfare, parkway, throughway, road, avenue, boulevard, lane, place and other such terms.
STREET, ARTERIAL: A street designated as an arterial street by the council. It is the primary purpose of an arterial street to carry fast or heavy traffic.
STREET, COLLECTOR: A street designated as a collector street by the council. A collector street has the primary purpose of carrying traffic from minor streets to other collector streets and arterial streets.
STREET, COMMERCIAL: A street designated as a commercial street by the council. It is the primary purpose of a commercial street to provide efficient movement in a commercial area.
STREET, DEAD END: A street connecting to another street at one end only and not having provisions for vehicular turnaround at its terminus.
STREET, FRONTAGE: A minor street, parallel to and adjacent to an arterial street, which has the primary purpose of providing access to abutting properties.
STREET, INDUSTRIAL: A street designated as an industrial street to provide for traffic movement in an industrial area.
STREET, LOOP: A minor street which forms a loop and returns to the same street from which it originated. A street forming a connection between two (2) other streets is not considered a loop.
STREET, MINOR: It is the purpose of a "minor street" to provide access to abutting properties.
STREET, PARTIAL: A dedicated right of way which provides only a portion of the required street width.
STREET, REVERSE FRONTAGE: Lots that front on more than one street, but have access to only one street.
SUBDIVIDER: An individual, corporation, firm or group who undertakes the subdividing of a lot, tract or parcel of land for the purpose of transfer of ownership or development, including dedicating of streets, or change of street or lot lines.
SUBDIVISION: A tract of land divided into two (2) or more lots, parcels, tracts or sites for the purpose of sale or development, whether immediate or future.
UTILITIES: The installation of water, sewage, gas or electricity and similar facilities providing service to and used by the public. (Ord. 8-96, 11-11-1996; amd. Ord. 5-99, 1-10-2000; Ord. 7-2008, 9-8-2008)
