10-6-11: VIOLATION; PENALTY:
   A.   Violation; Penalty Imposed: It shall be unlawful to erect, construct, reconstruct, alter, maintain or use any building or structure, or to use any land in violation of any provisions of this zoning title, or any amendment thereof. Any person, either an owner, lessee, occupant or otherwise, who violates any of the provisions of this title, or who interferes in any manner with any person in the performance of a right or duty granted or imposed upon him by the provisions of this title, shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined not more than one hundred dollars ($100.00) or imprisoned not more than ten (10) days or both. Each day during which such violation shall continue shall be deemed to be a separate offense.
   B.   Remedial Action: If any building or structure is, or is proposed to be, erected, constructed, reconstructed, altered, maintained, or used or any land is proposed to be used, in violation of any provision of this title, the city council, the county prosecuting attorney, or any owner of real estate within the zone may institute injunction, mandamus, abatement, or any other appropriate action or proceeding to prevent, enjoin, abate or remove such unlawful construction, reconstruction, alteration, maintenance, or use.
