10-4-2: R RESIDENTIAL ZONE:
   A.   Definition: The R zone shall include any small tract of land of less than five (5) acres which shall be used for residential purposes, and shall be designated as an R zone. The following shall be an R zone:
      1.   R Residential Zone: R residential shall be lots within city limits, with a minimum lot size of fifty four feet by one hundred forty feet (54' x 140'), where public water or public water and sanitary sewer systems are available. The minimum area of a corner lot shall be not less than eight thousand (8,000) square feet and the minimum area of an inside lot shall be not less than seven thousand five hundred sixty (7,560) square feet.
   B.   Lot And Building Requirements:
      1.   Lot Size: No Principal Dwelling Unit shall be erected or building altered to accommodate one family as a residence on a lot having less than forty thousand (40,000) square feet of lot area and width of at least one hundred fifty feet (150') per side, except where municipal water and/or public water and sewer systems are available, then the minimum lot size may be reduced subject to any city regulations thereon.
      2.   Building Standards: All structures placed on lots or parcels of any size must meet standards, rules and regulations set up by the state board of health or the district health department. All lots within the city limits which are connected to municipal water and/or public water and sewer systems will be exempt from this provision.
      3.   Number of Principal Dwelling Units on a single lot or parcel: No person shall maintain two (2) or more separate occupied one-family Principal Dwelling Units on a single parcel.
      4.   Accessory Dwelling Units: The installation of an Accessory Dwelling Unit in new or existing single-family dwellings (hereinafter Principal Dwelling Units) may be allowed in single-family residential zones, subject to the specific standards listed below.
         a.   A maximum of one (1) Accessory Dwelling Unit is permitted, per lot or parcel.
         b.   The ADU structure must comply with all residential building, health, safety, and fire codes.
         c.   The ADU structure must meet all zone requirements concerning setbacks and height.
         d.   The Accessory Dwelling Unit shall not exceed 75% of the size of the Principal Dwelling Unit or 800 square feet in floor area, whichever is less.
         e.   Accessory Dwelling Units shall contain no more than two (2) bedrooms.
         f.   The exterior appearance of an addition or detached Accessory Dwelling Unit shall be architecturally compatible with the Primary Dwelling Unit. Compatibility may include, but is not necessarily limited to, exterior building colors, and roof form and pitch that meets snow load compatibility.
         g.   Separate entrances shall be oriented towards the side or rear yards.
         h.    A minimum of one (1) off-street parking space shall be provided for each Accessory Dwelling Unit.
         i.   Accessory Dwelling Units shall have separate water, sewer, and power connections from the Principal Dwelling Unit.
         j.   A temporary ADU may be installed with a conditional use permit.
   C.   R Zone Permitted Uses: The following uses and no others shall be deemed class R uses:
   Accessory Dwelling Units.
   Bed and breakfasts by conditional use permit.
   Boarding and rooming houses by conditional use permit.
   Child and/or adult care facilities.
   Churches and church schools.
   Colleges and private schools.
   Dormitories, sorority and fraternity houses.
   Halfway houses by conditional use permit.
   Handicapped homes.
   Hospitals, rest homes, convalescent homes and nursing homes.
   Mobile home parks by conditional use permit.
   Multi-family dwellings of three (3) or more units by conditional use permit.
   One-family dwellings and duplexes.
   Preschool age nurseries.
   Public parks, playgrounds and other recreational areas owned and operated by governmental or other nonprofit institutions.
   Public schools.
   Other uses related to or incidental to the primary uses set forth in this subsection, including, but not limited to, garages, incinerators, identification signs, home occupations and private swimming pools. (Ord. 2-2015, 2-9-2015; amd. Ord. 3-2015, 2-9-2015; Ord. 2-2023, 8-14-2023)
