§ 130.01  RETAIL THEFT AS AN OFFENSE.
   (A)   A person commits the offense of retail theft when he or she knowingly takes possession of, carries away, transfers or exerts unauthorized control over any merchandise displayed, held, stored or offered for sale in a retail mercantile, establishment with the intention of depriving the merchant permanently of the possession, use or benefit of the merchandise without paying the full retail value.
   (B)   Retail theft shall also include the alteration, transfer or removal of any price tag or similar marking in an attempt to purchase the merchandise at less than full retail value.
   (C)   For purposes of this section, RETAIL MERCANTILE ESTABLISHMENT shall mean any place where merchandise is displayed, held, stored or offered for sale to the general public.
