442.04 PHYSICAL QUALIFICATION TO OPERATE COMMERCIAL MOTOR VEHICLES.
   (a)   No person who holds a valid commercial driver's license shall drive a commercial motor vehicle unless he or she is physically qualified to do so. Each person who drives or expects to drive a commercial motor vehicle in interstate or foreign commerce or is otherwise subject to 49 C.F.R. 391, et seq., as amended, shall certify to the Registrar of Motor Vehicles at the time of application for a commercial driver's license that he or she is in compliance with these standards. Any person who is not subject to 49 C.F.R. 391, et seq., as amended, shall also certify at the time of application that he or she is not subject to these standards. (ORC 4506.10(A))
   (b)   Whoever violates this section is guilty of a misdemeanor of the first degree and shall be subject to the penalty provided in Section 408.01.
