648.09 CURFEW.
   (a)   No person having legal custody of a person under eighteen years of age shall knowingly permit or recklessly allow such minor to be or remain away from the premises where such minor lives or is staying after hours, as follows:
      (1)   Sunday through Thursday: 10:00 p.m.
      (2)   Friday and Saturday: 11:30 p.m.
   (b)   No person under eighteen years of age shall be or remain away from the premises where such minor lives or is staying after the hours set forth in subsection (a) hereof.
   (c)   A minor under eighteen years of age found away from the premises where he or she resides or is staying during the times set forth in subsection (a) hereof shall not be in violation of this section in the following instances:
      (1)   When accompanied by a parent or guardian;
      (2)   When accompanied by an adult authorized by a parent or guardian of such minor for a designated period of time within a specified area;
      (3)   When exercising first amendment rights protected by the United States Constitution, such as the free exercise of religion, freedom of speech and the right of assembly. Such minor shall evidence the legitimacy of such exercise by having in his or her possession a written communication signed by such minor and countersigned by a parent or guardian of such minor with their home address and telephone number addressed to the Police Department specifying when, where and in what manner the minor will be away from his or her residence or the place where he or she is staying during the hours when this section is otherwise applicable to the minor in the exercise of a first amendment right specified in such communication.
      (4)   In case of reasonable necessity, but only after such minor's parent or guardian has communicated to the Police Department the facts establishing such reasonable necessity;
      (5)   When returning home by a direct route from and within thirty minutes of the termination of a school activity or an activity of religious or other voluntary association; and
      (6)   When returning home by direct route from and within thirty minutes of the place of employment of such person under the age of eighteen.
   (d)   Whoever violates subsection (a) hereof is guilty of a minor misdemeanor and shall be subject to the penalty provided in Section 698.02. Any minor who violates subsection (b) hereof shall be dealt with in accordance with Juvenile Court law and procedure.
