04-07-39: MISCELLANEOUS PROVISIONS:
   (1)   Severability: Should any section, clause, paragraph, sentence or provision of this article be held invalid for any reason, such holding or decree shall not be construed as affecting the validity of other remaining portions hereof, it being clear that the City Council would have adopted the remainder of this article notwithstanding the invalidity of any said section, clause, paragraph, sentence or provision. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.
   (2)   Conflicts: All other articles and parts of other articles inconsistent or conflicting with any part of this article are hereby repealed to the extent of the inconsistency or conflict.
   (3)   Interim Period: The period between the date of passage of this article and the dates hereinafter specified shall be considered the interim period, and this article shall be administered during said period in accordance with the following provisions:
      A.   Until the authority (City Council) passes the initial POTW facilities plan and the Public Works Director issues a permit/special agreement to any affected user pursuant to that plan:
         1.   Any user discharging into the POTW under an existing user agreement shall be considered to be operating under a special interim agreement/permit under this article; provided, however, any provisions therein which is/are contrary to state or federal law or allow pass-through or interference are void. The Public Works Director shall give any such affected user notice of this action;
         2.   Any other user or new user/new source who either indirectly or directly will discharge or discharges into the POTW any pollutant or any other substance which requires the issuance of a permit/special agreement under the provisions and regulations of this article shall apply to the Public Works Director for an interim permit/special agreement which shall be processed under the provisions of this article. The Public Works Director, when considering an application for an interim permit/special agreement, must consider and issue and/or deny an application for a permit/special agreement subject to the City IPDES permit, the POTW operational capacity, the existing use and expected use and demand of that capacity.
